housing benefit is based on income and is not related to how/why you left your job

Possibly. HB is means tested, and cannot be paid if you have savings above £16k.

You will need to complete a council HB application form.

You may also be able to apply for Income Support.

As joint tenants you will have to put in a joint claim so documents will need to be provided for both of you, if your intention is to become your partners carer due to fibro and mental health issues then sorting out benefits is just one of the many jobs you will have to undertake on her behalf.

Just a couple of things to think about:

How much notice do you have to give at work? Have you any holiday that you can take in lieu of notice?

Is your partner in receipt of Employment Support allowance, even if she has a nil award because of your earnings? Has she ever been assessed for ESA?

If she has never claimed ESA then...........

If you have savings less than £16000 then you can claim Income Support as a couple as a 'top up' for your Carer's Allowance.

Income Support will give you automatic entitlement to full HB up to your personal circumstances.

You will not be able to claim Carer's Allowance and Income Support until you finish work (because of the hours and amount you are earning).

So, first thing to do is find out about work.

Then make a claim for Carer's allowance, (they will help you with the date you can claim from,) then Income Support which should give you automatic entitlement to HB.

You must also inform tax credits of your change of circumstances.

Google for contact details for all the departments you need to speak to and they will talk you through when your claim can begin and the documents you need (have paper and pen ready!)

Hi there thank you for your advice i just phoned my work to give my notice i had holidays due in two weeks time so they said they might be able to give me that for my notice period.

Partner has never claimed esa before. so do you think best option is to claim for income support and carers allowence? do you know if i can phone the council and state i am no longer in employment so cant pay them rent until i get housing benefit sorted? i dont want us to get chucked out of our council house.

    Thanks again Gary
