Not fit for purpose?? Go-Pro memory card.

Options
A friend went to get a memory card for her go-pro from currys. She took her go-pro with her, and asked the sales assistant for the biggest possible card. They sold her a 64GB Micro SD card, her Go-pro only can take a 32GB card max. She has unwrapped the card, what are the chances of them taking it back since they were the ones that (wrongly) advised this card?

    Its part of the consumer rights act that goods should be fit for purpose. Usually that is the purpose they are commonly supplied for but if the consumer makes known to the trader a particular purpose, then the contract is to include that as a term of the contract.

    In other words, your friend should have rights under the consumer rights act as the goods fail to conform to contract.

    Thank you, that was the legislation I was looking for. Knew I had head it before. To be honest, I think I will be getting the job of returning it.

    Would Currys staff know the specs for a go-pro?

    If somebody said to me that they want the biggest card to fit an item I would be looking at the largest card I stocked of that format E.G. SD, MMC, xD etc. I would expect the consumer to know the largest size in terms of GB as they have the manual for it.

    I thought it was strange that a GoPro would only take a 32gb card considering there are some models that record in 4K and it is only certain models that are restricted to 32gb. I would say there is equal blame here or ever all on your friend. If someone asked me for the biggest card for a GoPro I would automatically suggest a 64 or even 128, until I just double checked I didn't know any gopros had any size restrictions. Other than it needing to be a micro rather than standard card. Why didn't your friend check the specs first to know the maximum card she could use?

    This would be different if she was buying the GoPro at the same time and was sold the wrong card.

    Currys sell GoPros, they have the product there in front of them, I would expect the sales assistant to acutally check what size fits, otherwise what was the point in asking for assistance, OP's friend could just have picked up a card and paid.

    OP, if you do take it back and ask for an exchange, you can't just have a 32gb, it has to be a 32gb Extreme card, a normal 32g won't work either.

    Currys staff don't seem to have any kind of basic technical training and from my experience give wrong advice on even the most basic questions.

    As always they should have researched it online and bought it online as well. This would have been much cheaper than buying in Currys. Even argos was half the price for a 32gb memory card than Currys the last time I looked.

    Plus if she asked for the biggest card to fit the Go-Pro then the 64gb will still fit, the Go-Pro just won't be able to use it ;)

    True, there is no way thst the staff can know everything about all products thst they sell which is why if they don't know, they should either look it up or simply inform the customer that they don't know.
    As unholyangel rightly stated, if asked for something for a specific purpose then the item supplied must be fit for purpose required. If it isn't then a breach of the Consumer rights act has occurred.

    Most of the go pros accept large capacity cards, 64gb being common. Due diligence should be done by the customer and not left to chance.

    It could be argued that by asking for advice from a sales assistant at a store where Go Pro cameras are being sold, due diligence was carried out.

    In answer to some of the points raised.
    The friend in question is an utter technophobe, GB/MG/ITV/LB and ounces, all the same to her, no idea. Thats why she was willing to pay more than the cost on the internet and buy in store following the advice given by the saleperson. Go-Pro was bought from the same store, so that is why she went back there.
    She was just going to give the card away when she found it didnt work, but I think that she should try to return it, for the reasons I mentioned earlier. We pay extra to shop in a store, and part of that extra cost, surly is because we get the help and advice of people who work for the store.
    But thank you all for the comments. Guess it just boils down to how they feel on the day when it is returned.
