Returning a faulty item within 14 days ?

Hi my son bought a T shirt from Gym King (on line retailer)
The T shirt arrived with a hole made by the excessive stitching of the logo. He went on holiday for 2 weeks intending to return the T shirt for a replacement when he came back.
However, it seems that the sites t&c's state that all faulty goods must be returned within 14 days of receiving them and that p+p must be paid for by the customer.
I thought that he had 30 days to return faulty goods and surely he shouldn't be liable for the returns postage.
He wants the T shirt replaced with another one exactly the same except in perfect condition
Where does he stand please?

The seller must cover the cost of the return.0 -
You are correct. The consumer rights act gives consumers up to 30 days to reject faulty goods and yes, the retailer is legally responsible for covering the return postage costs.
However, if they do agree to this, your son can't insist on a replacement as the retailer can opt to refund instead.0 -

Now, what's the best way to get a prepaid returns label.
I'm pretty sure that if he paid for the return then it wouldn't be refunded.
He paid by paypal. I'm hoping that this gives him extra security.

Paying with Paypal gives different 'security', not always extra 'security' and mostly not more than legislation gives. In your son's case, Paypal will give him 180 days to open a case for SNAD (significantly not as described) but he will have to pay for the return and it needs to be tracked.
It may be worth contacting Gym King and highlighting the part of the legislation showing your son has 30 days to reject the item and that Gym King must cover the return cost.0 -
Having had a brief look on their website, they fall well below what they should be doing with regards rules and legislation in relation to online selling. I cannot see a registered business address, but if you use company check.co.uk they appear to be a legitimate company and their address is there (should you need it later for an LBA).
So that you are clear. Your son should get a full refund (they are not allowed to retain the outward postage costs) and the returns postage should be refunded/reimbursed/supplied.
I see there is a similar request on their Facebook page (for a prepaid label) you may want to join that conversation and post the links to the legislation there.0 -
Excellent advice here, I agree they should accept within 30 days.
