Car quote legally binding?

You have ignored the elephant in the room.
The cars price may stay the same, the spec could be improved and due to being the latest specification it may have residual advantages over the older model.
It may even work out cheaper.
If you put up the vehicle make and model somebody might be able to advise better
And I must have missed it in your earlier posts, why are you quoting a 25% increase in price?
But without make and model..........0 -
Hi bigjl,
Elephants should be left to roam outside lol
It's concerning a Ford Kuga Titanium Sport, Panther Black, with Keyless Opening with 'Hands-free' power tailgate, appearance pack, family pack, satnav Sync2 and towbar for £315/mo incl maintenance.
In the last few days it has emerged that the new ST line will replace the "Sport" at a higher price point as besides the grill and seats, they have also adjusted the suspension, upgraded the SatNav (Sync3) and some other bits and pieces. If I can get the same spec for the same price on the new model, than that is fine ... doesn't look like it though plus the delivery of the new model seems to have been pushed out to early 2017 with orders taken as per 1st September. I need a new car by start of October.
So ... 1. due to higher pricing of the new model (already revealed that the base model will start at £1250 more than presently) and 2. the prospected delivery date vs my need-by date, I will still need to rely on getting the old model. Again ... no issue on my side as wasn't too keen on the new model's looks anyway ...
The lease company had offered me 2 "alternatives" for the present model ...
* Titanium (White) with additionally the convenience pack (Active Park Assist) and 19" alloys but no keyless/HF tailgate (not an option as the keyless and the sport version is non negotiable);
* Titanium Sport (Metallic) with additionally Active City Stop and 19" alloys but no family pack (don't mind this one but keep reading) ...
Both excluding maintenance for £345.
That is not a like for like or even close substitution. It's called a farce!
The issue is not the spec ... we can work on that ... it is the pricing! I have a contract for a specific car, all signed an approved, fees paid, credit checks done, finance agreement signed, set up with all parties involved and ready to take a DD on the press of a button!
A maintenance contract costs about £35/month so adding this onto the £345 of the new quotes will come to £380/month, that is a 20.6% increase vs my signed agreement of £315 ... (25% was a rough number at the time) ... Over 3 years time that is ... a lot of money!
When I originally posted the question, I was just wondering what (legal/non-legal) actions are available to me (I have thought of multiple scenario's and maybe someone has other helpful suggestions although I don't want another brand/model).
I have also checked the contracts, the contract with the finance org Arval does not state anything in this matter ... but it does say I only have very limited time to cancel the agreement ... the Order form with the lease comp states "If the exact vehicle detailed above is not available by the date required, XXX will offer an alternative". In my mind that does not include offering a re-quote for a much higher amount ... the alternative should be an approximate like for like ...
Cheers!0 -
I have a contract for a specific car
A specific car which does not exist, and will never exist.the lease comp states "If the exact vehicle detailed above is not available by the date required, XXX will offer an alternative". In my mind that does not include offering a re-quote for a much higher amount ... the alternative should be an approximate like for like ...
And they are offering an alternative. You don't think the alternative is acceptable - that's fine. They're offering it.0 -
As it will ... the car does exist and it's in production for me right now with Ford directly! Broker was just trying to get me to cancel the contract as they made a mistake in the quote! Therefor offering "alternatives" that had no relevance to my contract with them and claiming they could not alter any of the specifications of cars still to be produced. All lies! Too bad for them I got an even better deal elsewhere and definitely will never use them again! Cheers!0
