Car quote legally binding?

Hi, I have been provided with and accepted a car leasing quote (PCH), the leasing company has done a finance check, I have signed the order forms, the financial forms, received a written confirmation of the order and paid the Leasing co's handling fee £180. However, the company was too late in actually booking it on the system and it seems the order books have now (temporarily) been closed down in order for the manufacturer to update the "new" model. I was under the impression that a quote is legally binding but it seems the leasing company wants to re-quote me (no doubt for a higher price!). Can they do that and what options do I (legally) have? Thank you.

    I don't imagine they can be forced to lease you a car that they can't supply, whether their fault or not. I'd say they have to put you back as you were, at least, by returning any monies paid.
    Anything above that will probably be 'goodwill' - eg, discount / higher spec on the replacement order. Ask if any of their nominated dealers have any suitable cars available from stock?

    The Ts & Cs will certainly have a get-out in the event that the vehicle ordered cannot be supplied because of events beyond the lease company's control. The manufacturer stopping taking orders because production is stopping is definitely beyond their control.

    Unfort no stock available up to the spec I had selected with either dealers or in old production line :(. They have others but only with spec that I don't see the use of at all (eg. lane assist - if you can't keep your lane you should not be driving!). The new books will be opened in the next few weeks again so I don't see why they can't add it back on then. Especially since the car's company itself at the moment keeps on saying that it is NOT a new spec, just a spruce up of the front bumper. So NO stop in production either, just a few new parts to be added. Will check the Ts & Cs again tomorrow but couldn't find anything so far. Time is getting a bit tight now for another order as they have wasted a whole month with this order and my old lease is coming up top an end. The car's comp has on average 12wks so am stuffed either way it seems ... :(

    Just because it has a feature does not mean you have to use it.

    I have never used the auto lights on my car, my brain can quite easily think its dark and its time to turn the lights on.

    Doesn't sound like a quote to me, sounds like a legal agreement for which I doubt if you decided you didn't want it they'd have charged you to walk away from.

    Read the paperwork to see if they cover anything like this. If not then they probably are breaking the contract. Problem is if they don't have the car your a bit stuck. Of course dig your heels in, tell them you'll find like for like elsewhere and pursue them if there is a price difference, but ultimately if they don't offer a solution your happy with you may just find yourself getting a refund and walking away

    I don't mind the extra options :) but they want to re-quote me for it and I am not intending to pay for options that I don't want.


    Will give them a few weeks extra to sort things out and if not, see if they are willing to cancel the agreement and we will start all over again ... elsewhere ...

    There are usually terms and conditions that say that they cannot guarantee the specification of a vehicle and that it may change, in which case the quote is no longer valid as its effectively not the same car. This is always the leasing companies fault and is usually down to the manufacturer.

    Manufacturers specifications can change on a monthly basis, depending on many factors. Sometimes this is due to lack of parts or run out models, etc.

    With a quote I would understand but I have signed ALL the paperwork already, including the financial agreement and paid the arrangement fee. I will see once the order book opens up again (should be in the next 2 weeks). I think they had wanted to pick one of the ones on order already and change the specifications, which is fine with me. But the books are also closed on the cars already on built. They admitted they have made a mistake but it was a bit premature of theirs to start quoting (25% higher) for a different specification that I don't want, especially since the sales person knew/should have known how carefully I have selected the present spec. The many email conversations were with him I thought after all. Any way ... I have calmed down lol thank you all for your responses and let's see what happens over the next few months ... I have seen better deals on a higher spec already off the court elsewhere ... they will be wanting to get rid of some before the new model comes out :)
