Consent Order and form D81

Options
I've agreed a financial settlement with my ex-wife and wish to get a consent order drawn up.

I'm completing the shortened D81 form and just wish to check what numbers should go on page 2 and the process that follows.

1) I'm assuming it's the full value of everything as it stands now. Not details of the settlement.

2) Additionally, I'm assuming that it's full value of pensions even if elements of these were accrued prior to marriage and are being ignored as part of the settlement.

3) My solicitor will then draw up the consent order and send it to my wife. She should take legal advice before signing it. Once she has signed it my solicitor will send the documents to the court for what should be a rubber stamping exercise.

NOTE, I'm not asking my solicitor these questions to save £96!

Yes, the details on the D81 are of the financial position as it is now, not what it will be after the order is made (so if you own a house together, you would normally each declare 50% of the equity, for instance)

There is a box (I think from memory Q9)which asks about any other relevant information and, subject to your own solicitor's advice, you *may* want to add in information about (say a significant proportion of pension having been built up before the marriage, if on the face of it the order looks very unequal.
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)
