  • Could i still take Micheal Savva to court as my sofas. Everyone ive ever had have been faulty . i had to pay for a independent surveyor and was told that it was faulty by the surveyor and then micheal said he will have them fixed so i gave him the 3 mths he asked for as he said it was coming from the manufacturers. We got these sofas just before xmas 2015 by dec 2016 i was either hoping that i would have a fixed sofa or be refunded in Full. Can i do a private or small court disputed against him ?

    No, it is unlikely that you can sue a director for a limited liability company's failure.

    How did you pay for the goods?
    If it was by credit card, or perhaps a loan arranged by the seller, then the credit provider is equally responsible with the seller for performance of the contract.

    This means that you can use Section 75 of The Consumer Credit Act to seek a remedy from the credit provider just as you could from the seller if they were still trading.
