Maybe pay what's owed and ask them to correct your file to a point that its factual.0 -
takman, I explained my reasoning for not repaying this debt earlier. I've been refunded all payday loan fees from Wonga and QuickQuid however Swift Sterling are saying that because they are Maltese the UK law doesn't apply to them. Well call me a patriot but I am a UK citizen so this law does apply to me.
Besides, I think you might have missed the point of this thread? I'm asking how to approach what is clearly a falsifying of information by a company. Can you not see that this is wrong?0 -
DCFC, I don't care about the score anymore. But this record was due to legally drop off. Which it won't anymore and I have no idea why not.
I don't have any money worries these days and I would pay the money if I could be convinced it would make any difference. They seem to have a track record though - "Motormile-and-yet-another-false-default" - Taken from consumercreditaction0 -
Like I say, it may be a bit early to conclude they're falsifying. But if they claim not to be subject to UK law perhaps their entry on your credit reports may be erroneous? I'm no expert though, so you're better off speaking to maybe the CAB or something?0

If they are operating in the UK, I think they will find that UK law does apply to them...0 -

Not paying a loan back just because they didn't carry out affordability checks is a poor excuse!. You need to take some responsibility and not take out loans you can't afford.
But like others have said it's not clearly a case of falsifying information until you know why they put it on there!. It may be wrong but not paying back the loan is also wrong. So i think it's only fair that they mess you around abit.0 -
If there are questions about the affordability of a loan then you should complain to the original lender, as this is their responsibility.
You should complain in writing stating why you think the loan was unaffordable and highlight that they never checked your ability to repay the money. Asking them to remove all interest, fees and negative data from your credit file.
If the case goes to FOS and the loan is found to be unaffordable they will insist this is done, however you will always be liable for the capital you borrowed as you benefited from the money, unless they agree to wipe the debt for whatever reason.
In the meantime, you should query the default date with the debt agency again in writing.0 -

I have had exactly the same with them. They put a default on my credit account in April 22nd this year. When I asked for a copy of the default notice that they had sent to me, they forwarded me a PDF of the default note, only they had the date of April 4th on the letter and I have email correspondence with them showing that they did not have my address until June of this year. I have made a complaint with the financial ombudsman today regarding them falsifying documents. I really think you should contact them too. Do my ramblings make sense?! Ha!!0 -

I have been trying to make regular written correspondence with them for a while, trying to get this escalated internally but when I mention anything regarding a complaint or escalation the emails from them go silent, yet when I was requesting documentation the response was the same day. It was at that point I realised they had been falsifying documentation and I'd had enough as they were clearly unwilling to continue further correspondence that they deemed wasn't in there benefit. I have tried to follow the company's procedures. X0
