ParkingEye charge notice when I didn't even leave my car?

    Yes this is the exact car park! It's just off the side of a one way system near Leeds train station. Do you therefore recommend trying to appeal this and following the steps on the forums?

    Why wouldn't you appeal?
    Stop thinking of this as a fine too, it's not, it's an invoice of course it's high the PPC's are greedy scammers!

    No one thinks you are making excuses, if you had been sitting in your car and a council warden spotted you chances are he would move you on, a private parking attendent would hide and issue his ticket to trap you.

    But you have been done by the sneekiest scam of all ANPR, which has even issued a parking charge to a shopping trolly with a VRN on it.

    Yes, absolutely appeal!

    In the first instance you appeal to Parking Eye via their website using the BPA blue text template in the Newbies section and select 'Registered Keeper' only in the drop down box (keep a screenshot of your appeal) Parking Eye will inevitably reject the appeal but must then provide you with a POPLA code. You can then submit a full appeal to POPLA similar to other 2016 appeals on this forum.

    As previously noted, Parking Eye have lost a number of cases at POPLA for this car park due to the messy redacted contract they provided. Post 6 in the attached thread below includes a link to the evidence pack Parking Eye sent to POPLA/ Appellant in May this year,

    Once you have your POPLA code, come back and post your draft appeal for the experts to critique.

    PARKING CHARGE NOTICE
    PARKING CHARGE AMOUNT DUE £100.00
    Payment to be made within 28 days issued
    This parking charge is discounted to £60.00 if paid within 14 days of the date issued.
    After this, the full parking charge amoun will be owed.

    Then there is my location Aire Street Leeds followed by my time in the car park of 20 minutes and my arrival and departure time alongside two photos of me entering and leaving the car park.

    Then at the bottom there is all of the details of the parking charge. The date I entered and departed the car park. It makes reference to signage 'clearly' being displayed along with tariffs and terms and conditions. It mentions paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012 that I am required to pay this in full however they do not know my name or postal address so if it wasn't me driving the car I need to let them know who was.

    Then there is a warning of after 29 days that if I haven't paid they have a right to recover any unpaid parking charges and again references to Schedule 4 of the Protection of Freedoms Act 2012.

    That is the full Parking Notice I received and on the reverse is just details on payment information and where to go to appeal.

    Darn, the dates stack up but it was worth asking. So appeal as per post #13, standard 'registered keeper' appeal.

  • OP, Edna Basher has just posted details of a POPLA win against Parking Eye at the same car park where your pcn was issued (Aire Street, Leeds) The unreadable 'contract ' PE provided was the winning point. There have been several other wins for the same reason.

    Have you received your POPLA code from Parking Eye yet? Once you have received the code, you can then submit a fuller appear to POPLA , similar to other POPLA appeals in the forum from this year. Your appeal should include the 'no authority' point as PE keep presenting this unreadable contract to POPLA in their evidence packs.
