ParkingEye charge notice when I didn't even leave my car?

Hi all,
Today I received a parking charge notice from ParkingEye from when I was away in Leeds. I was starting my drive back from Leeds to Newcastle and pulled into a small car park off the main road to set up my Sat Nav for the drive home. The letter I have is of two pictures of me entering the car park and leaving the car park and the duration I was supposedly in the car park which was 20 minutes as I didn't have signal on my phone and my TomTom takes a while to start up. At no point did I actually leave my car and at no point did I even properly park in a parking bay. Does anyone know if this is a legitimate appeal as a £100 parking fine for pulling into a car park to set up my SatNav when I didn't even park sounds a bit harsh to me?

yes its legit, welcome to the rules on private parking
you failed to comply with the rules in that car park , stopped , parked , in or out of the car, in a bay or not , all irrelevant
you had a maximum of 10 minutes to comply with the parking rules or leave , you did neither
harsh or not, its legit as far as these things go

in future, stay on public roads in a reasonable place with no restrictions0 -

So even though you're saying this is the rules for private parking do you still think it is worth going through the appeals process?

that is your choice to make as it depends on many legal factors, the same factors you would use in a popla appeal
none of what you said in post #1 is relevant to an appeal
the cameras monitor vehicles entering and leaving and the computer determined "time on site"
the cameras do not monitor where the car stops, or if people stay in it or leave it, nor what they are doing as its not relevant
its private property, you had no permission to park and you did not read the signs or comply with them, whatever they said (what they said is important as its part of the contract for you to stop on that site for any length of time)
as they are a member of the BPA , the BPA CoP outlines the rules , plus there are contract laws that you may have broken
you have been issued with an invoice (not a fine) , if they take this to court, a judge will decide
and yes they do go to court, they issue over twenty five thousand court claims a year
the high profile one was Barry Beavis , 3 court cases , 11 judges , he lost every one, go figure
one of the Supreme Court judges even said
"all he needed was a watch"0 -

Follow Redx' advice, you should use the appeal from the newbies thread which will be rejected then appeal to POPLA you may be lucky with the right arguments.
I'm sorry but I just don't know where the urban myth "I didn't even leave my car" came from, or "I didn't even turn off my engine" or "I wasn't parked I was waiting"!
PPC's love these excuses and laugh all the way to the bank!0 -
It genuinely isn't me trying to make an excuse all of what I've wrote is what actually happened, I've always thought as long as I was in the car I couldn't get a parking fine. I've just never experienced anything similar to this hence my post on here along with many others with similar issues!

Did the PCN arrive within 14 days of the parking event and does it mention 'after 28 days blah blah Protection of Freedoms Act 2012...keeper will be liable?' Half way down the front page.
Welcome to the nasty, money-grabbing fat cat world of private parking firms. Back in the day you would have been clamped before that was make a crim offence. Not that the 'potential crims' (and some of them were) and their chums went away.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yeah that's right! I've got a £100 parking fine which is 'discounted' to £60 if I pay within 14 days and the payment is to be made within 28 days, so sounds exactly like the one's you're describing, just seems like such a high fine for 20 minutes!0

Would this car park be Aire Street in Leeds by any chance? This is a small car park just off the main road in Leeds city centre where Parking Eye have lost a number of forum assisted appeals at POPLA this year by providing a messy redacted contract which POPLA assessors have been unable to confirm whether Parking Eye actually have authority to operate.0

Yes this is the exact car park! It's just off the side of a one way system near Leeds train station. Do you therefore recommend trying to appeal this and following the steps on the forums?0
