hire purchase early termination

Hi, I posted recently in regards to an early termination. I'm now in the process of doing said termination.

Peugeot have replied to my request stating I need to pay 70 pounds in arrears, which is fine as this gets me to the 50% mark.

They also want me to sign a form to make me liable for excess mileage and damage. Do I need to sign this and return it? I was under the impression I just need to be firm and tell them I am returning the vehicle as I am entitled to.

    No, you don't need to sign anything else. I take it you do have excess mileage then?

    Even if there was he'd be liable for the damage regardless and he can't be held liable for excess mileage with a VT, so no requirement to sign anything extra.

    Then it doesn't really matter, however, you're still under no obligation to sign anything.

    Thanks for the advice. Today I'm going to write back to Peugeot and advert that I am not obliged to sign any additional documents or forms, I am exercising my right to cancel early. Should I also send the remaining £72? I'm just concerned I'll end up paying another installment at the end of the month, to just send the vehicle back a week later.

    Is there any damage to the vehicle? The cost of that extra months payment maybe worthwhile so that you can repair it rather than them bill you hundreds for each scratch.

    It's now mid September and despite two more letters to Peugeot advising I will not be signing any more forms I have had no response.

    I've spoken to consumer advice and they say I may have to sign their forms.

    The termination part of the contract is as follows:

    Termination: Your Rights
    You have a right to end this agreement. To do so, write to the person you make your payments to. They will then be entitled to the return of the goods and to half the total amount payable under this agreement, that is £5,334.68 . If you have already paid at least this amount plus any overdue instalments and have taken reasonable care of the goods, you will not have to pay any more.

    I have paid over the 50% mark and I have took reasonable care of the goods! Peugeot have told me they have received no further letters from me and I MUST sign their form which states i'm liable for damage and excess mileage before the car can be returned.

    Any advice on where I should go from here would be welcome.

    Presumably there's also something in your original contract re condition and mileage - if they're persistent then just resend your copy of the contract and leave it at that


    I've never had an issue with either VW Financial Services or FGA Auto Contracts (Alfa Romeo)
