Is Lastminute.com affected by Lowcostholidays??

Hi

I was just checking the T&Cs about being ill on the Lastminute.com website, before going on holiday, as my child has chicken pox.


This is there introduction.
When you book a pre-packaged holiday through the Holiday path on the lastminute.com UK website (a “Holiday”)your contract for your holiday will be with Lowcostholidays Spain, S.L. trading and registered at Calle Ada Byron s/n, Planta Baja, Puerta 5-A, Edifico Estel, Parc Bit, Son Sardina, Majorca (“we”, “us”, and “our”) and these conditions detail the terms which will apply to your contract.

lastminute.com at all material times acts solely as a web host and search facilitator to enable you to book your holidays with Lowcostholidays Spain, S.L. lastminute.com has no responsibility whatsoever for any Holidays you book, nor has it any responsibility for the accuracy of the descriptions about any Holiday, or for the prices or price descriptions of any Holiday.

lowcostholidays.com ("we", "us", "our") is the trading name of Lowcostholidays Spain, S.L., whose registered office is at Calle Ada Byron s/n, Planta Baja, Puerta 5-A, Edifico Estel, Parc Bit, Son Sardina, Majorca. Although we are a Spanish company, we are happy to make our terms and conditions for our customers in the UK subject to English law and the jurisdiction of the English Courts. This is to help you be certain of your rights.

Because we are a Spanish company, we have to comply as well with Spanish law. This means, apart from anything else, that our financial protection arrangements are those required by Spanish law, and we explain this at Section 4 of these conditions.

If you book a flight with accommodation and/or other travel product(s), this is a "Package" falling within the Package Travel, Package Holidays and Package Tours Regulations 1992 ("the Package Travel Regulations").


So basically is my holiday affected by this??? I don't know where I stand. Due to fly out Friday 22 July! I booked a hotel and flight through lastminute.com.

Any advice/info greatly appreciated!

    It certainly looks like it to me. lastminute changed hands some time ago and says all it does now is help you book with Low Cost and those are Low Costs booking conditions as I recognise the wording.

    If you have details of your flights, check with the airline concerned usually through 'Manage my Booking' or some similar term on their website and then contact the hotel, many in Spain seem to be cancelling Low Costs bookings as they can sell the rooms for a lot more due to demand. If you paid by credit and some debit cards you may be able to claim your losses from them but to ensure you actually have any holiday, get checking now

    I'm a bit confused as Lastminute.com sent me an ATOL certificate. But Martin Lewis says lowcostholidays has no Air Travel Organiser's Licence (Atol) because in 2013 it moved its business to Spain.

    The ATOL issuser is BravoNext SA.

    Its a flight and hotel in Lisbon Portugal.

    Just noticed this at the end of my email confirmation from Lastminute.com
    TERMS AND CONDITIONS
    The contract for your City Break/Flight + Hotel is between you and BravoNext SA (part of the lastminute.com group). BravoNext SA is a company registered in Switzerland under company number CHE-115.704.228, with its registered office at Vicolo de Calvi 2, 6830 Chiasso. Its VAT number is CHE-115.704.228 IVA.

    Your booking is ATOL protected under BravoNext SA's Air Travel Organiser's Licence (ATOL) number 11082. You will receive an ATOL certificate in a separate email, which lists what is financially protected, where you can get information about what this means for you and who to contact if things go wrong.

    More and more interesting. Bravonext is based in Switerland (!) but I suspect you have an ATOL Certificate which says 'Flight only' in the bottom right hand corner? If so it doesn't protect the accommodation at all, Low Cost were known to be issuing ATOL Certificates to make it look as if the holiday was protected when it wasn't. The CAA who organise the ATOL scheme tried to stop them but I believe ABTA objected and the plans were stopped.

    If your ATOL Certificate says Flight Plus or Package then you are protected and need to contact BravoNext themeleves, their number is 0041 9120 3301 which of course is Switzerland.

    Lesson for everyone, make sure you book air holidays with an ATOL holder in the UK

    On the certificate it says:

    What is protected?
    Flight and Hotel Package to Lisbon for 7 nights


    It says Package Sale on bottom right corner.

    So I should be okay? :/

    Yes you should so long as Bravo, which I am sorry to say does appear on this site with regularity, understands what they are doing but you are now in a strong position to insist you get what you paid for

    What do you advise I do?

    Call the hotel to check I'm still booked in?
    Do I need to call Bravo?
