Landlord bankrupt

Hi all,

I was renting an apartment since Oct 2014 and vacated around Oct 2015. I have been up to date will all my rental pay. I left the apartment to live with my family for a while. I have contacted my ex-landlord multiple times to state my leave with no luck on contacting him, so I just packed my things and left. Now that I want to move back out again, I have found out that the landlord from the previous apartment became bankrupt in Aug 2015 and lost the ownership of the apartment. I have recently returned to the apartment to give my spare key to the new tenant. (I could not return my key to my ex-landlord because of no contact). But I have found out that the apartment is still empty, with no sign of anyone entering since I left.

My question is, is it legal for me to continue living in this apartment?

Who would you pay the rent to? I assume the flat has a new owner so you would be classed as a squatter I think.

Well, let's assume your tenancy didn't end when you physically moved out. If that was the case then you would still have retained the right to live there alongside the requirement to pay rent. That would put you in about nine months arrears.
  • Thanks for the replies.

The estate agents told me the landlord was bankrupt.

Also I assume a bank owns the apartment now? I have no way of knowing who has ownership. I have no knowledge regarding squatting rights and laws. Do you think I could live there? I would pay all utilities and council tax, but no rent?

    Thanks
  • I don't believe any paper work was processed regarding my tenancy. But I contacted the landlord with no avail and have not received any information on the new ownership.

    Squatting is illegal.
  • I apologies for being naive, I do not understand how this situation works. What legal action would be taken against me if I did move in?

Ps. I have tried to contact the new owner of the apartment, but cannot find any details. Is there anything you could suggest I do in regards to finding the new owner?

So you continued paying rent since October?

Otherwise, squatting is a criminal offence...
