Everything parking, notice sent too late?

Quick question, have received a charge notice via post, date of incident 15 th june, letter dated 30th June. Proof is cctv image of car entering and leaving car park with times.

So pcn was sent on the 14th day from day after incident, plus the 2 working days for delivery, add the weekend and you get 18 days, which does not meet the requirement of receiving within 14 days.

Can I ignore this notice or shal I appeal?

If I ignore and they take it to small claims surely I would win?

    proof is likely to be ANPR camera pictures of entry and exit , not CCTV

    small claims court is a lottery, yes you may win , but only if the judge finds for you on legal grounds

    read the NEWBIES sticky thread and appeal, as KEEPER (not driver)

    only a fool would ignore a pcn (invoice)

    You don't need to fight it in court, a keeper can win this one at POPLA. Use the usual first appeal template for BPA members, in the NEWBIES tread, which already mentions the POFA so it doesn't need tweaking.

    Do not say who was driving. At POPLA stage, yep, the fact the postal Notice cannot have been 'served' in time means the keeper appellant can't be liable as long as no-one has implied who was driving.

    Ok thankyou, I will send the template in newbie thread, but not mention that it has been sent too late.

    Then get popla code and appeal stating it was sent too late

    Then hopefully win and complain to dvla they are sending void notices out in the hope of payment

    Will keep thread updated

    Do they not offer online or email appeal?

    BTW at POPLA stage it is not recommended to only use one appeal point. You will need to read other POPLA threads first, to see what to say in addition to the keeper liability issue in case POPLA don't make the right decision. Other points give you a safety net at POPLA stage.

    They've never been to court and I wouldn't think they would start with you, costing them in excess of £200 and a shed-full of work requiring brain cell application in the hope of winning £100, with as much of a chance of losing as they do of winning!
