  • So this happened earlier today: I was served a Statutory Demand under section 268(1) of the insolvency act 1986. Debt for liquidated sum payable immediately. For the sum of £93k This time there is a full schedule of debt. Not only does it include the statute barred £3k I dealt with above (for which I have received no response) but every payment made over 8 years to me as the private foster mother of the creditors grandson. I have 18 days to deal with this. The guy who served this on me said I would be made bankrupt if I didn't successfully get this set aside.

    Take legal advice - go to court with your solicitor - get it thrown out and ask for costs - end of - I think.

    Need legal advice pronto I believe. I litigated against him in late 2015 in the family court. My QC suggested then he was a nafarious character. I stopped litigation to bring the child home and agree access when I ran out of money. The Creditor, the grandfather, my former friend, is now out to get revenge on me.

  • I applied to have the statutory demand set aside. On the day I took no more evidence and went alone. The judge appeared disappointed the other party had sent a solicitors agent and he hadn't appeared in person. The judge was cross at the waste of court time and within 2 minutes had set it aside and awarded me a few hundred pounds costs. I didn't have to say a single word.

    Oh and I never did hear from AYL again.

  • And the saga continues....

    The costs awarded to me were not paid. I chased the other party and reminded them, then issued a money claim. The other party eventually paid up the original amount but not the £25 fee. When I was asked if the debt was now settled by the Court, I truthfully answered No. The other party then counterclaimed by falsely saying I owned him £150 plus £25 costs (total £175). The matter was referred to Court mediation. I have agreed to mediate, the other side hasn't responded. Strangely no court date set but I am chasing the courts for a date. He has gone from suggesting I owe him £93k to counterclaiming over a £25 court fee !

    And we have a hearing date! I have written to him asking him to settle and stop wasting public resources. No response. He took it upon himself to deduct the £175 he claimed (fictitiously)that I owed him from the next set of airfares he had to send me. He really is a very silly man, I am not backing down on this one.
