Does this mean that if you have a few many drinks the night before, but also happened to have some seafood at the restaurant before going out, you can definitely conclude that the sickness was due to the diner rather than then excess drinking and get compensation!

Surely that would mean a very large number of holiday makers finding an easy way to repay for their excessive alcohol consumption!
