Complain to the local licensing authority - it wont cost you anything unlike small claims. They'll contact the minicab operator (uber) and ask them whats happened - and Uber are more likely to give specific details to them than they will you.
As for the driver not saying anything at the time, perhaps they didn't notice. This is especially likely if it was the back seat. And even more so if we're talking about a peak time for them - in those instances its possible it was the next customer who noticed it and not the driver.
I'm not telling you not to complain and try and get to the bottom of it. Just saying its perhaps a bit risky taking court action. In small claims you don't need to prove something beyond all reasonable doubt, you just need to prove that its what probably happened (balance of probability). You keep using that word. Just an update here.
I persisted with my claim against Uber and after about 3 or 4 emails going back forth and the threat of small claims (which I would have seen through) I got the entire amount refunded.
Persistence can pay off!
Thanks for all the advice guys0 -
If you go to court you'll probably lose.
Uber have a photo of the incident and you admit that you were asleep for the journey so don't know whether or not your friends did anything.
I would like to see how you would defend this in court. Uber have hard evidence, you have nothing.
Not that it matters now but I'd hardly call their one photo, which could almost be of anything, "hard" evidence. If they had a thought out policy and cab drivers had to report spillages before their next fare with several photos as evidence, so it can be clearly demonstrated that a spillage has occurred in their cab, at the time they say, then I'd agree. But that wasn't the case here.0 -
Op did you say earlier that you'd read lots on the Internet about Uber making these claims ? Well speaking as an ex Black Cab driver, i hope you've learned your lesson and tell all your friends what you think of Uber.
Glad you won.Liverpool is one of the wonders of Britain,

Haha my uncle is a black cab driver so I know where my allegiances lye most of the time, I had read several stories of people claiming the same as me, whether they were true or not who knows.
Putting aside that I felt this was a blatant lie, I may have let it go if the charge hadn't been so ridiculously high (if it had been sick or something similar I could understand).
The picture they sent me was so ridiculous, it reminded me of that skit on 8 Out of 10 Cats Does Countdown:

You dont need the http bit at all when posting links. Just put the rest, not even the www bit.
Just everything after, it will be easy for people to copy and paste then.

I presume you're unaware that fees are set by your local authority? Drivers can choose to accept less than the designated fare, but they're not allowed to charge more than that (part of their licencing conditions).
It varies council to council. Most here are £40 but theres one or two thats £50.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

I have to admit, I really don't understand the animosity from black cab drivers towards Uber in the UK. It sort of makes sense in the US, but in the UK, Private Hire is a well established alternative to black cabs, with established licensing requirements set by the local authority. Over here, surely Uber would be "just another private hire firm" who happen to have a better system than their rivals?0 -
Your friends are unlikely to cop to it, so if I was you I would expect it to be split 3 ways. All you have to do is tell them and get 20 quid of each of them simples.0
