    Hi guys,

    Well where do I start, Not much has happened after the survey was done and sent to my neighbour, I gave him 14 days to restore my fence however on the 8th day he sent an email to my solicitor saying he did make contact and suggested a joint survey, I then wrote back myself and sent the letter recorded delivery advising that he should do his own survey and we can then decide by how much both surveyors agree. He also mentioned I was aggressive and tried to have him arrested lol. The police himself got fed up and tried to broker a peace deal but he just came up with dumb excuses.

    Now prepping all paper work for court proceedings, believe me I do not want to go to court but I don't want to lose my land either even after showing him all the evidence he still refused to accept.

    I will keep you all updated, I have spoken to a few surveyors and probably spent over 4 k on legal advice so far, this is my home, my castle and must protect it too bad I can't use cannons and trebuchets lol.

    Good luck Pilavas! It's a nightmare isn't it...can't believe some people...we are just waiting to see what the insurance say re the claim but we have pretty much agreed with the other neighbour that if they don't take it we will try to do it ourselves between us. x

    Personally - I don't "get it" re his fighting about this sliver of land to this extent - as it does seem to be the case that that bit of land originally belonged to "next door" and wasnt "bought and paid for" by his house. So I don't rate OP's chances of hanging onto it personally.

    Personally - I don't "get it" re his fighting about this sliver of land to this extent - as it does seem to be the case that that bit of land originally belonged to "next door" and wasnt "bought and paid for" by his house. So I don't rate OP's chances of hanging onto it personally.
    That assessment ignores the fence, in place since the 1960s, giving the OP exclusive use of the drive as it was.

    I don't think any of us is in a position to say which way this could go.

    Not sure you understand, I will try and explain it better.

    I went to view a few properties to buy
    Decided on the current one as it had a side garage
    Put offer and was accept
    applied for mortgage and accept
    exchanged and completed on the 12 of July
    13th July Neighbour takes my fence down and digs into my concrete
    Ask him why he says title plan says that part is his,
    just by looking at the title plan map he decides this

    I just got there and bought the property what right does he have to take the land I paid for ?

    Hopefully this makes much more sense I know I am spending a stupid amount of money but I can't let him walk all over me.
    He claims it's his land so why wait till I bought it ?
    Money, seriously If you don't understand the situation please ask and I will clarify even more, even happy to call and explain verbally If I have to. You just seem to be taking the side of this bully.

    I told him on numerous occasions he can't do this and chooses to ignore my plight. I intend to live there till I die and every day I will look at his side extension will make my blood boil !!!!

    So no way am I going to let this slight.

    I had no intention of arguing with my neighbours, I just wanted to live a peaceful life and not have any altercations with anyone. I have never had any sort of issue with any of my previous ones.

    Money has her own, fairly unique, view on many issues. She had her own border dispute, which got so vitriolic she wished her elderly neighbour dead and in a coffin. She got herself very wound up, and that legacy of anger still punctuates many of her posts. She has also, and regulars will boggle at the fact, been on an assertiveness course!

    To Money, black is black, and white is black. Terms like thief are bandied around like confetti. If you are a regular here, it can be mildly amusing at times. If you are not, and are seeking advice, I imagine some of her postings can be devastating. She is without empathy.

    I add the detail for the OP's benefit, as he's going through the same stressful time now as Money did a couple of years ago.

    OP: take posts by Money with a large spoonful of acid: they'll taste better. The strength of her vitriol is only matched by her lack of knowledge.

    Others of us here, besides money, have been involved in serious boundary issues.

    It is hard to keep a sense of proportion, especially where threats and real aggression is shown, but it's always best to keep calm and resist these in a civilised manner.

    That doesn't mean lying down and accepting what comes, but every situation is unique, due to the character of individuals, so it's hard to give more specific advice.

    The only thing I'm sure of, is that litigation is always costly, and therefore a last resort..

    That's one thing that is for sure - it is indeed hard to keep calm where there are threats and real aggression happening.

    That is what I was on the receiving end of personally and there was a heck of a lot of attempted intimidation going on against me - so I do know just how upsetting it can get (particularly if you're not in your "own" area of your country - but the intimidators are).

    Fortunately - I had the proof that my land (all my land) is mine and all legitimately "bought and paid for" and it all got successfully resolved in the end. That being - the attempts to seize/use my land have stopped. The main culprit is studiously coming nowhere near me these days - and that's fine by me - whew!
