Quick update, My neighbour has or may be getting into a dispute with the neighbour on the other side of his house regarding an extension they are building. Apparently they had a verbal agreement that they can go ahead with there extension as they will need to dig 3 metres down next to his extension. he is now not happy and sent a notice from a land surveyor to stopped digging for a month. not sure what he is playing at.
As for me and my dispute, postman had to card him and the letter my solicitor sent him is still at the depot clearly he knows it's from me.
So waiting for the return of the letter and will deliver it by hand this time. Can't believe how annoying these people are!!!!0 -
Another quick update, finally got the letter back and decided to post it myself, went for special delivery pre 9 am and I saw it arrive at 08:27 am
on Saturday. My neighbour signed for it and 20 minutes later I noticed he re cordoned off the piece of land he took lol. So clearly he think he is still right.
So next step now is to give him the 14 days mentioned in the letter and see if he decides to give in.
What I don't understand is he still thinks he is right I mean !!!!!! does he actually think he will win this ?0 -

He sounds like he is not going to give in. Like my neighbour, who was clearly in the wrong but ploughed on anyway. You may be in the position where you have to take him to court. This could be very costly, with no guarantee you will be awarded costs.
The dispute he has with the other neighbour sound like the neighbour has not got a proper party wall award in place? In which case he is perfectly entitled to stop the excavation.0 -

In your position - I'd go out in the middle of the night (so no witnesses) and remove the rope and then stick an innocent look on my face if anyone asked me if I knew where it was.
That - from someone who believes in being honest and does so usually - even if "smacked across the face" about it (which I have been before now...:cool:).
Your land - so anything on it is your decision as to what to do about it. The denying it - well <shrugs>. They couldnt prove it...
NB; Do not tell anyone else what you did. I've learnt by now that the person who can be trusted to keep a secret is a very very rare creature indeed.0 -

Can't you just remove the rope, return it to your neighbours land and put something there to stop them doing it again. Park a vehicle (like a trailer full of manure) on the area of land they are trying to claim? I wouldn't be creeping about at night as its YOUR land, you need to make it clear that you will not let them just take it from you.0 -

I'm sure you can come up with a few ideas.
Where I live, scrap cars are sometimes used as gentle 'reminders' where there has been a transgression. I know of two that are currently performing this function.0 -

Can't you just remove the rope, return it to your neighbours land and put something there to stop them doing it again. Park a vehicle (like a trailer full of manure) on the area of land they are trying to claim? Manure sounds good. I've heard of a farmer before now that got rid of a group of travellers from his land by spraying them with manure:rotfl:
The putting difficult to remove possessions of yours there is another good 'un. Had rather forgotten I've had to do this myself before now - it worked. I was going to put a scrap car there myself if need be - but didnt have to go that far.0 -

Myself and other neighbour have put a pack of evidence together which we think proves he is wrong and has told bare-faced lies to us on matters that are checkable so I am sending this to insurers this week to see if they would fund a legal challenge as we want it sorting once and for all...apparently he has tried this on with both sets of people in our and neighbours houses before then gone quiet for a few years...Iv'e been here 4 yrs and it has only just cropped up! The person he bought from also confirms it is a load of rubbish so fingers crossed..we have gone past trying to reason with him as apparently every document and photo we have including documents from the Land Registry are wrong!0 -
Sounds like he's a chancer then.
Swot him back into touch and that should be the end of that for you - if not for any future owners of your house (as it sounds like he's the type that will try it on with an owner/accept defeat and then come back for another go when it's the next owner).0
