You have a problem with a white lie to beat a scam?
Ever said to a cold caller at your front door who wants to quote for some lovely stone cladding, that you only rent the property?
Ever scam-baited a cold caller on the phone about PPI reclaims, telling them you are interested just to waste their time?
White lies.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nope. I say, not interested thank you, and shut the door! And I put the phone down - why waste my time, just to waste somebody elses? I've only ever once received a parking ticket too - and I paid it! I "Nipped in to the bank" without paying and displaying and was only gone 10 minutes. I got caught! Suck it Up, Buttercup!0

PE threatening court action when they know that their contract with ALDI forbids it could be construed as criminal i.e. attempting to obtain pecuniary advantage by deception or put more simply fraud. PE already have form for untruths in letters sent to motorists. The judge in PE vs Somerfield concluded that ParkingEye had committed the tort of deceit when certain letters were sent to motorists.0 -

Nigelbb - go back to page one and read what Quentin wrote!
And do you know this is the case with Margate????? Perhaps you should investigate each one before gobbing off about how the charge is appealable on such grounds? Personally, I think that you are causing the OP more time and effort and costing her another £30. I could be wrong.
I am entitled to my opinion as you are yours. Just because you dont like mine doesnt make it any less valid. I dont think people should lie. The OP was very honest when she came here originally and is now being told to lie/white lie/bend the truth. I dont agree with this advice. If the charge is appealable or has loop-holes you can manipulate, fine. But DONT LIE!0 -

You are wrong - we would not try to help people on this board if we thought we were 'costing them' more money in the long run. And the OP said she's an Aldi shopper anyway so she should either get this cancelled early on or can be coached to hopefully win at POPLA as the signage is atrocious at every Aldi, worse than normal for ParkingEye.
There are always (yes, always at Aldi in particular, the worst offender) huge gaps in car parks with no signs at all - also 90% of signs/banners that are up at points dotted around the car parks, do not mention the £70 - plus there are usually hidden terms/keypads in a corner of a shop where no Aldi staff member tells people to look even if they spend £100 at the till, people still get these fake fines. Even genuine shoppers get sued, if they haven't kept receipts.
That's why I feel it is perfectly OK to say ''here are all the Aldi receipts which were in my car and after a rummage in my family's shopping bags even though I can't find a receipt from that day''. And if one or two of those receipts are wombled, how does that matter? A scam is ended and the person hasn't actually LIED! They only need to say the receipts were 'in their car' (which wombled receipts would be once picked up...).
And many, many of these Aldi sites require under planning laws, allowance for shoppers to shop elsewhere. Guess what, we've seen evidence of Aldi/ParkingEye LYING about that! Look, a BIG FAT LIE on a sign in Aldi car parks:

...and at this store Aldi were fined for lying about the time limit so PE could fine more people, THEN they also briefly put 'Aldi customers only' signs up which was also contrary to the Planning Consent. Those 'Aldi customers only' LYING signs lasted less than a week, after an MSEer complained to the Council about all the people being fined for heinous made up 'crimes' like daring to go to the paper shop or cashpoint or collect their pension money from a shop over the road as well as some bread & milk from Aldi...etc:

You are the one who jumped to a huge conclusion as so many do, thinking that a Supermarket car park is being abused if people shop off-site. Some are, some aren't, but private parking tickets are still ALWAYS a scam and unfair and not to be paid.
This is MSE, this is the parking fines board. We don't tell people to pay these vulture firms. We tell them how to beat them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I didnt jump to that conclusion at all! She admitted that she shopped off site, and that car park is for Aldi customers only. I checked! She wasnt an Aldi customer during this period AND SHE OVERSTAYED!
Presenting some receipts as evidence and claiming that they are her own when she has picked them up in the car park is NOT TELLING THE TRUTH!
We are not going to agree, so you can carry on telling people to be dishonest. I hope she DOES get her charge cancelled, but if she doesnt, i hope she asks YOU to pay for it.
Lots of love xx0 -
Here is a link to Google Street View of ALDI Margate. The sign at the entrance has a large P with the BPA Ltd roundel then underneath in a smaller font
1½ Hour Max
Stay
Then in a much much smaller font
For use by customers only
https://goo.gl/maps/xiAT1e4TB532
That sign doesn't mention any penalty for overstaying & doesn't specify parking is for customers only while using the store.
If PPCs want to use contract law to enforce their parking regimes they must do it properly. The offer of free parking for 1½ hours is clear but any other conditions are not so. It's perfectly possible to get the signs right & other PE sites have adequate signage but this site does not. PE cannot rely on these signs to enforce a penalty as this core term is not brought clearly to the motorist's attention as it was by PE at Riverside Chelmsford in the Beavis case.0 -

Did you check with the Council Planning Department or the signs in the car park?
