    It doesn't matter, they won't reply meaningfully and you will not/cannot 'just get' a CCJ! You will either get court papers or you won't, some do, some do not. Even if you lost at court in a defended case, then paid, you don't get a CCJ so they mislead you there.

    DO NOT BE MISLED INTO PAYING.

    Hoohoo posts here as well and his response suggestion is a good one, as always - but I would just alert you to a typo in that letter:
    I will escalate to the CSE.

    should be
    I will escalate to the CSA.
    (credit services association)

    Look at LoveNorfolk's thread last week for a shining example of a complaint he/she is making to the CSA and the SRA about BW Legal's letter.

    Thanks I am now at home and looking through the letter and it says:

    "County Court Proceedings

    In the event County Court proceedings are issued you maybe liable for court fees, further solicitors costs and statutory interest. Should we successfully obtain a County Court Judgement ("CCJ"), this may have a detrimental effect on your future creditwortiness and employability. Our Client also reserves a right to commence enforcement proceedings against you for recovery of the balance due."
    In my original post I stated from the letter "we require payment in full within 16 days from the date of this letter."

    So with this in mind would the below letter be the best to send as it seems to differ from what my letter states?

    "Complaint
    I wish to raise a formal complaint regarding your letter. Requiring a response within 10 days to a letter before claim is against practice directions, which require a minimum of 14 days."

    In my letter it states 16 days to require payment in full. Would this be the same thing?

    Looks like you have been sent the same standard letters as many other people.
    Check the wording of the letter as some letters have the word "WILL be liable for court fees" which is very naughty and should be brought to the attention of the court, if it gets that far, but should be mentioned in any formal complaints letter also

    Keep calm, dont pay, dont be an easy target.
    These people are unregulated operators never mind how many logos ata's they are members of. Legalised crooks

    I don't contribute as much on here as I used to. This is often because the same problems with the same advice recurs time and time again and the correct advice is readily available from the "search" option.

    But when an OP can't follow simple advice given early on in a thread without coming back and back, that is probably a main reason why I get so bored with groundhog day.

    As do I. But to be fair to this OP they've read other BW Legal threads first, which is more than loads of posters on here and on pepipoo who just launch straight in (pepipoo today drove me mad for the sheer number of people starting the same darn thread as if they are blind...and clearly they are not).

    Anyway, people worry about the lies about 'getting a CCJ at the drop of a [STRIKE]hat[/STRIKE] court claim' so we still need to assist with the fight.

    I have had another look at the letter and it says maybe liable for fees.

    So I am now going to send them the letter when I get home tonight with Coupon-Mads amendment and see what happens.

    I will update as needed.

    Yep, if it goes to court and if you lost, the court fees would be added to the PCN of £100 and you would finally have to pay. Making a total of maybe £150 - £175 altogether (hence why there is no point whatsoever paying £154 now without a fair hearing!).

    Cases are won as well, so posters here pay nothing at all even when they get court papers, because unlike some places, we don't churn out crappy template weak defences.

  • Ok so I have arrived home from holiday to find the following letter from BW Legal oh and sent to my parents where I haven't been for 3 years.

    As I have just received it and its been 7 days how should I respond?

    Have you made a complaint to the SRA? You should, the more complaints they get about these rogue claims the more likely they are to take action, and, it costs the PPC money.

    Look on ppp for a letter by Gan to one of them blasting them out of the water. Include a request for a breakdown of their demand for £54 which is more than is allowed. Also, you might like to consider a written complaint to your local Trading Standards Officer.
    You never know how far you can go until you go too far.

    Hi James,

    Just search this forum and pepipoo forum for 'BW Legal £54' to read loads of examples of how to reply which we can't repeat every time but are easy to find. If you respond robustly, BW Legal sometimes do not proceed further and look for easier victims. If not, if the case proceeds to a small claim then at least your response shows you acted reasonably and replied, didn't ignore it. And a small claim is not a big deal, simply a matter of finally deciding if you have to pay or not, no huge costs and even if you lost it would not be likely to be as much as the £200-odd being sought now.

    Or a Google search 'BW Legal faithfully' and try 'BW Legal £54' which will immediately find you pepipoo forum posts (some written by Gan) of formal letters of response. If it is a Letter before Claim this time, just read those results which refer to a LBC. Even if you more or less repeat your response from before that would do. If you can email it, do that, saves wasted stamps.

    The important thing with BW Legal seems to be to keep responding and show you are not 'low hanging fruit' that they would more likely pick for a claim.
