whats my rights, smashed tv screen

We bought a tv from argos about 2 months ago. We decided to keep it for our new kitchen. So never opened the box until today. Mounted the tv on the wall on bracket. Turned it on and found It has a crack screen. Builders saw the tv in our room unopened. I guess with their words we can prove tv was never unboxed until today. What is our rights? Thanks.

    Whether you have witnesses to the unopened box or not, I forsee you having a lot of problems claiming for a cracked screen 2 months after purchase. Hopefully someone will have better news but I fear this may be a tough one to solve. :(

    Go into Argos and explain politely what happened, you will 'almost certainly' get it replaced.

    Was the box completely in tact and do you still have it in tact to show that it hasn't been damage while you've stored it for two months? Depending on the type of crack this may be an easy situation or a very difficult one. If it has cracked from the edges then it could have happened while boxed, whether in their possession or yours with no way to prove it so they should sort it.

    If it is cracked from somewhere more central (impact damage) then unless the box is damaged it is near impossible for the screen to suffer impact damage while boxed without the box also getting damaged, TVs are usually packaged with polystyrene supporting the frame with nothing touching the screen and just empty space between screen and box making an impact impossible without damaging the box.

    Was it laid on a protective surface such as a soft towel on a flat surface while the bracket was fixed to the back or even kept upright? It's not unheard of for people to accidentally crack screens while fixing on brackets.

    I'm afraid such "witnesses" are hardly proof of anything. Why would Argos have to accept the testimony of some random builder?

    Regardless, you'll have to take the set back to the retailer to be certain what they will do...

    I bought it online. So I dont think I need to take it back myself as it was delivered. There is a little damage on thebox exactly where the crack is on tv. I never looked at the box before though as never thought there would be crack on tv. I will put a picture of the box if I can now.

    The onus would have been on you to check the box at the time of delivery and reject it then, not two months later.

    As previous posters have said, anything could have happened in that time.

    Argos MAY be willing to offer a solution but I wouldn't hold your breath.

    that pic shows a hole in the box, it doesnt show when that hole appeared or wether it has anything to do with the cracked screen.

    as others have said take it back to Argos and see what they say, having it delivered makes no difference as it was 2 months ago

    From the picture that is the sort of damage that could have occurred any time within the last two months .
