Cancellation of Three SIM-only contract

Does anyone have any advice around cancelling a three SIM-only contract that I took out in store? I have since had a better offer from my current provider, and after ringing Three and being told there was a 7-day cooling off period, I then went ahead with a new contract with O2 thinking that I'd be able to cancel the Three one.

I called the Three store and was advised the cooling off period only applies to contracts/phones taken out over the phone (distance selling regs). Called customer services and they said they cant cancel and I'd need to contact the store, then spoke to someone else who said they'd put through a 'cancellation request' and I'd hear from them via email in 24-48 hours. I imagine I'll just receive an email saying sorry it cant be cancelled!

The 3 SIM isn't even activated yet, there is a 30 day delay on it, and I haven't even opened the SIM card envelope so perhaps this will go in my favour?

Very frustrating as I wouldn't have taken out the contract with O2 if Three had told me I couldnt cancel, and I now have two contracts :(

Can I write to them, will this make a difference?

    Unless they offer a good will gesture (which they don't have to), you're stuck with it.

    They are right, there is no cooling off period for anything bought in a store, whether it's a phone contract or anything else.

    If Three stick to their guns, you might be better to cancel your O2 contract. If you arranged the new O2 contract by phone, you can cancel the O2 contract under the "cooling off" period.

    Also, Three are normally quite good to deal with, I would try talking nicely to their sales people... Writing to them isn't the quickest way, and time isn't on your side.

    Thanks for your advice! I'll try again with Three and then if not I may need to cancel my O2 one as there is a 14 day cooling off period.
