PCN - Euro Parking Services Ltd

Hi I could do with some guidance please.

I received a PCN from Euro Parking Services on 07/06 for not being parked correctly within the markings of the bay or space.

I have waited the 28 days as advised and I have not been sent a NTO.

I'm just wondering what my next course of action should be.

From what I can gather, the company is listed as an AOS member, but not a member of the ATA. Do I send the "Dear IPC member" letter?

    The NTK (not NTO) will follow between day 29 and day 56. Then yes, you send the IPC version appeal, then ignore them after that unless they try a small claim later on.

    There is no further appeal worth trying beyond one challenge to 'look reasonable' and nor are they worthy of your money.

    Just about to send the IPC version appeal, they spelt my name incorrectly does that make any difference?

    No.

    It's a speculative invoice anyway, which you won't be paying, so what does it matter if they spelled your name wrong?

    Is your name spelled wrong on the V5 for the vehicle?

    It seems my letter was ignored and I have now received a letter from Gladstones - Letter before claim.

    Do I state I had previously contacted the firm however they have not responded to my letter and then similar to below?

    Ref : ****

    I have received your Letter Before Claim dated September 2016.

    I deny any debt to Euro Parking Services Ltd

    The driver is not identified in your letter and your client has failed to meet the requirements of The Protection of Freedoms Act to pursue me as keeper.

    You also cannot presume that I possess all the documents referred to in your letter.
    Please send me copies of all the documents sent by the client including the windscreen notice if one was attached to the vehicle.

    When these are supplied, please also confirm whether the intended action is founded on a contractual charge, a breach of a contract or trespass
    Please confirm that your client's contract with the land-holder includes specific authority to take legal action and that this will be produced for the court.
    I also require an explanation for the additional £50 charge including confirmation that it has already been invoiced and paid.

    When I receive the documents and your explanations I will be in a position to make a more detailed response
    It would be unreasonable to proceed with litigation before you have clarified your client's cause of action.

    Yes, similar to the letter above sounds reasonable for a first response to a LBC. And you can add that indeed you DID appeal as registered keeper on xx/xx/16 (include proof...we hope you didn't just post a letter and got no certificate of posting).

    But people who do that are supporting the rotten industry, lining the pockets of fat cats and actually funding the next few PCNs against some little old lady, struggling family, etc.

    This forum is about fightback, not supporting this...
