Has it backed up the old vista install? A good clean up will probably be in order but if it is something like the HDD starting to fail you might push it off do do a backup of all essentials
    1. Get rid of old install
    2.turn on show hidden,system files
    3.clean out the temp folders
4 turn off your swap file
    5 disable hibernate
6 get rid of any old stuff u don't want on there(log files, run disk clean)
    7 defrag
    8 test
    9 turn on swap file/hibernate if u want/need

Personally, I'd do a clean install. But if you don't want to do that, maybe check that you have the latest Win7 drivers installed for your hardware.

Also check if you have any programs set to start with Windows and disable any you don't want. You can find them at the following registry keys.
    HKEY_CURRENT_USER\Software\Microsoft\Windows\CurrentVersion\Run
    HKEY_LOCAL_MACHINE\SOFTWARE\Microsoft\Windows\CurrentVersion\Run

You can convert the entries into shortcut icons (so you can run them manually and can restore them to the registry if needed). Just create a new shortcut somewhere and copy the registry name/value to the name/location of the shortcut. Or backup the entries in a .reg file.

If you have Windows Updates set to Auto it may still be doing catch up.

ive noticed svchost.exe is often high, around 50%, and trustedinstaller.exe can go from around 3 % to 20%

ive set windows update to notify me and i will install when i want to, also there have no updates as yet, its on sp1

ALSO, how long does it take for windows 7 to show the updates for the first time, ive tried manually downloading and shows 'checking for updates online' but nothing is happeniong

W7 post-SP1 can have win update broken from the start. MS have released a roll-up update for updates post-SP1 which can be downloaded independantly and applied, that should be your starting point.

statr on this page, and install the pre-requisites before getting the roll-up from the MS catalogue

Ive downloaded this update (was about 500mb) and it said it was successful, when i click on the download, a box opens with windows update standalone installer - searching for updates but, ive waited over and hour, keeps saying searching for updates

is there a process/ website that i ca go through to make this work

    upgraded (keep settings)

There is 100% of your problem, Microsoft has a VERY long history of not being able to do OS upgrades properly, for decades everyone with even the slightest bit of IT knowledge has known to always do a full clean install when switching OS.
