    I will make myself even clearer. IF the owner of the car can evidence a loss they have suffered as a direct result of an accident, that they would not have otherwise incurred as a result of the actions of a liable third party, then they can seek a recovery in court.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    You aren't unclear at all, just mistaken.


    It isn't the third party's responsibility that the "victim" took out a loan to buy the car that isn't covered by the market value.

    If you need a replacement vehicle pending yours being replaced by your insurer then the third party is responsible for paying for it (along with your other uninsured losses)

    I do have a courtesy car at the moment from my insurers.


    This issue is that enterprise won't let their car go abroad.
    I've asked my insurers if they can arrange something and they have said no.
    The third parties insurance have said to me that I should go through my insurance and they will claim it back from them. My insurance have said completely the opposite.

    Confused......

    You could hire a car abroad and claim the cost off third party.
