Can anyone advise re: returning a television bought online?

    Good morning all - thank you for your help and advice. Not avoiding a question of whether the item is faulty - not even sure where that idea came from - but yes, we are of the opinion it is faulty.

    Have you actually tried changing any of the settings associated with the output?

    What appears to be emerging is a dispute about what constitutes the sort of use one can reasonably expect before being able to ascertain whether it's suitable for purpose.

    If the tv is faulty then I believe you are entitled to return it for a full refund (as you have only had it for less than 30 days) regardless of the amount of normal handling, provided you have not misused or damaged it.

    If you are in a dispute, either regarding the facts of the matter, or over an interpretation of what the regulations are saying, then you may need to take the matter to court, and the court will make a judgement.

    Thank you. Is there any sort of clear definition of 'necessary'. I have taken it out of the box and tried it, which is what they're defining and using to deduct 45% of the cost.
    And then immediately boxed it up, or have you, as I'd suspect, been using it in the meantime despite no connection to your soundbar?

    It doesn't work like that I'm afraid.
  • Almost all TVs these days have an "hours used" counter in the hidden service menu, so it would be easy for the store to see if someone just inspected the goods briefly or used it 24 hours a day for a week before deciding to return it.

    To be honest I don't know why you had to call them twice. In your first post, following your first call, it is clear they were willing to replace a faulty tv.

    Still glad it has now been resolved to your satisfaction.

    I did initially call to replace the item with the Samsung model they also stock at +£100 more. Given their conduct now though, I don't think buying through them is something I'm keen on.
