Sketch 13, could you confirm the dates of the tickets please?
UKPC were banned from accessing DVLA data from approx 22/09/15 to 05/11/15.
Maybe clutching at straws but just wondered if any of the tickets fall within that period.0 -
Hmm...Surely they should have to give the right address of where I parked though? By that logic, they could have claimed I parked anywhere in the UK. I was under the impression that these details needed to be precise in order to stand up in court.

We don't disagree but it won't win at a hearing. You have other defence points - one will be that the UKPC signage is unreamarkable, badly placed and unreadable as far as the £100 is concerned (compare with the 'Beavis retail park' sign) and the fact the terms do not even offer a parking 'licence' to non-permit holders.

If you could prove the car was parked somewhere else other than in sight of the contractual signs they provide evidence of then yes of course its a defence point .
They will have pictures of the car at one place and claim to be showing signs from the one on their PCN.
Evidence needs to be robust to prove the balance.
If it was parked elsewhere even on the site, you can add in the argument that they are making a false claim to court and use their own pictures against them by showing the actual site they claim you were parked on .
Another defence point will be landowner authority, most universities are trusts that lease the land from a separate trust known by names such as XXX university estates trust.
The contract must be with the actual landowner not an agent.
So obtain land registry details of the land they are claiming.
Then send a part 18 request for the contract in un-redacted form and full disclosure of all evidence they have used to formulate the claim.
They can drop this on you at court of your bundle is not sealed, so on the date make sure your court bundle is tied or bound in red tape and leave anything they try to drop on you by moving seats and ignoring it.

Can someone just let me know if it needs anything else added to it? (I've only included the main text here. It is formatted properly elsewhere).

Please answer the following questions:
1. What is the basis of the claim. Is UK Parking Control Ltd making a claim as an agent of the landowner or is UK Parking Control Ltd making the claim as occupier in their own right? Please provide a copy of the contract.
2. Is the amount claimed by UK Parking Control Ltd for a genuine pre-estimate of loss for a breach of contract or a contractual sum? Please provide how this has been calculated.
3. If the contract has been conveyed by the use of signage on site, please provide copies of the signs on which you rely and confirm these are the signs in situ on the date of the event. Please also provide the date these signs were installed, for example, a works schedule, maintenance record or invoice for the work.

Please show how and on what basis, an added admin fee 'per PCN' has been incurred in each case? I will also require proof of UKPC paying £80 legal fees mentioned in your particulars of claim and proof that the signs upon which you rely for a 'contract' included clear warnings, in large lettering, re the £100 and the specific administration and other fees that you now seek to add.PRIVATE 'PCN'?
