Working on SA next, based on Claxtome's excellent SA!

Don't forget costs. Get a list in along with the SA,

Thanks for the reminder. I've got a schedule of costs started already. Will post in due course.

Its why the guide recommends printinig your bundle and hand delivering it. That way you know, for sure, they have it.

I would personally still do that.

I agree with nosferatu1001 about hand delivering your bundle to court.
Emailing it to Claimant is ok.

Means you can include a contents page and dividers etc...
  • Just finalizing SA and schedule of costs. Will post draft in a bit. Latest questions below:
    1. What needs to be included in the bundle that we provide on the day? Is it the SA, the WS and exhibits/evidence? All nicely bound, easy to access with an index on the front with an explanation of what's on each page?
    2. I think I need to create 3 copies: 1 for the judge, 1 for the claimant and 1 for us. Can someone confirm?
    3. I asked a while ago about representing my wife in court. I have found reference to The Lay Representatives (Rights of Audience) Order 1999. Does this mean that my wife (as the Defendant) can ask anyone to represent her? I.e. she could ask me to speak on her behalf in court?
Many thanks for your continued support.

Yes it can be useful to have some things in triplicate, plus proof that you emailed copies of everything to the Claimant. Take at least one copy of everything. Plus your costs schedule and proof you emailed that to the Claimant and the court, and proof of your wife's loss of leave/salary if applicable, and proof of costs to attend (travel, parking).

Yes take that Order with you and get there half an hour early, to be nice and calm and avoid any unexpected delay. Explain to the Usher that you are the 'lay rep' and if they say 'McKenzie friend?' say NO, you will be speaking for the Defendant as allowed under the lay reps order.

Hand it over if they query it, this is her right, to have you speak, as lay rep.

See Flying Horse's court report from yesterday. :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Are you also armed with evidence of your distress, for the counter claim?

To some extent - have referred to it in our WS, and will have a separate section in our SA. I can't say we are giving it a lot of focus to be honest, so our expectations are not great - winning will be our primary goal.
