Do you know what, that sort of article should be sent to Lord Neuburger and he should be forced to read the daily repercussions of the Supreme Court 'decision' in PE v Beavis that paved the way for such astonishing rip-offs, week in, week out.

He and the other 'Supreme' Court Judges (except the sensible dissenter) should be sat down and forced to listen to the people who have lost their homes, been credit clamped, harassed and dragged to court by scumbag ex-clampers who should not even have a job. All because of THEIR ludicrous 'decision'.

Before the infamous Supreme Court brain fart, the victim there would have been able to say to a Judge that he's paid the tariff and the charge is an unrecoverable penalty.

    Course it damn well is!

But no, Lord Cheeseburger and co. moved the goalposts. And this is the result, hope they are proud in their ivory tower. What were they thinking of, when they upheld Capita's rip-off penalty model?!

The fact that PE are offering a £30 settlement and instigating the involvement of debt collectors, suggests strongly that PE have no case against the motorist, otherwise they would have already issued court proceedings.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
