oh and I asked if some one would write to the nice PM ....
just wondered if a ' DPA breach ' could apply to cases such as this ?

Well done Ralph-y (or should that be Alc-y)and as a bonus received 4 beers and a nice merlot
DPA issues are starting to be explored on the forums - an interesting approach in fighting back. Have you seen Pranky's blog from yesterday?
http://parking-prankster.blogspot.co.uk/2016/11/smart-parking-settle-out-of-court-for.html
Even though the motorist settled for £275, £750 seems to be the advised level of compensation in such cases.
I think I'd wait and see how all this plays out and if successful cases emerge over the coming weeks before diving in. Don't forget, just like it is for PPCs in pursuing a claim, the motorist too has 6 years to issue court proceedings.

The signage only has a tariff from 6pm to 8am. Parking eye clock you 24 hours and state on their PCN that a charge is liable if you ' fail to make the appropriate tariff payment'. How is the motorist to decide what is appropriate tariff from 8am onwards if it is not displayed on the signs. Further, how is a motorist to pay, if for example he comes back after attendant has gone. He cannot pay the ,now missing ,attendant for the time he has spent parking from 8am, and the parking machine only accepts payment for time spent after 6pm. Do the terms and conditions apply only between the hours above as shown on the signs and if so why are they using ANPR 24 hours. Could you not use the fact that there is no mechanism in place for a motorist to eg pay for parking from say 8am to 8pm as a defence.0

Yes, as part of any defence.
But this is a really old thread by our standards, we have 40-odd new/updated posts here every day. If you have an unfair PCN to defend, see my signature, click back to page one and read today's threads.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, I watched the videos and read the sections: Help Etiquette and Rules but am still unsure how one goes about the mechanics of posting. I replied to old thread as I have seen many people starting new threads only to be told that a thread already exists. Should I not search for what I think is a related thread and post there regardless of its age ie keeping things on topic so to speak? Is the problem that I risk being ignored in a thread that has not seen any postings in a long time? It's still a learning curve for me:o:(0
