Difficult solicitors - advice needed

Agreed, but seeing as it's a new build, the developer does have all the answers. So for their solicitors to say that, it simply means they are not asking the right questions!0 -
So anyway, brook on our land, with a fence between, likely to cause us issues later down the line?0

Well yes, exactly which is why we're worried about progressing. It just seems an unknown to us - it is 'only' a drainage ditch but I assume they will need digging out every 5 years or so, which will bear a cost and require access.
Other than the points above its a lovely house but the sheer frustration of not getting replies is really putting a downer on it and taking the 'shine' off the house. We've started looking elsewhere but are split as to what to do - after all, it could be fine and we never need to do anything with it!0 -

Some of the worst flood jobs i've seen have involved this. Generally network rail refusing to clear a common ditch.

Sounds like you have experience in these matters... any idea what sort of cost is involved to clear a ditch around 28m long?0 -

Keeps running along the boundary of the neighbours property - it basically skirts around the development (edge of field) then goes into a sewer underground the other side of the development.0

So you are also relying on neighbours to keep their section clear.I am not a cat (But my friend is)0 -
I wouldn't think the developers a) know the answer or b) are following the instructions re surface water drainage. I wouldn't be willing to take this further personally0
