Disfigurement from using a beauty product, what are my rights?

Hi there,

A while back I purchased a home tooth whitening pen (the 'Snow White by Cougar), it came with no instructions except a tiny insert on the box telling me to apply it on my teeth every so often for an hour. Since using it I have a permanent white bleached stripe across my top tip which is very visible and likely to be there for life.

Do I have any rights in a matter such as this? I now have to wear dark lipstick all of the time in order to cover it, it is very embarrassing. Any advise would be hugely appreciated.

Kind Regards,

Gemma

Seek advice from a no win no fee solicitor, if they say no you have no chance as they know their stuff far better than anyone on here.
  • Good thinking, thank you very much :-)

Where did you buy it from? as this will make a big difference as to the options available to you.

The reason I ask is that I couldn't find it for sale anywhere in the UK and on the Amazon.com website, (where Cougar have their own marketplace page), it states:
Please be aware the Hydrogen Peroxide Teeth Whitening is available to outside the UK and EU
which implies that it hasn't been approved for sale in the EU.

  • Thank you for your reply.

I noticed earlier that they sell products from their own website but I bought it from site called Groupon which is quite popular for discounted deals and products in the UK.

That doesn't mean it is approved in the UK...

It is heavily publicised that many teeth whitening kits contain far too much peroxide than is healthy.

What does the ingredients list say on it?? Or was that missing along with the instructions?

I would say you stand no chance of any compensation, as using something dangerous like that with no instructions is just crazy!!

There is a good reason that dentists charge a fortune for teeth whitening!!

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

How exactly does a Groupon purchase work? (I've never used it myself).

Do you buy the goods from them or are they just a third party who negotiates discounts for customers and the goods are still purchased from another company?

OP have you sought medical advice? Have you approached the manufacturer about the issue? Have you approached the retailer? Have you ascertained that its the product at fault?

Do you have any medical evidence for this, or just your opinion?

The Amazon link provided earlier states that the produce is non peroxide and is simply a "teeth whitening gloss" so the stripe on your lip may well just be where some of the gloss (paint?) has stuck.

"teeth whitening gloss" sounds like a diluted form of Tip-ex to me.

Personally If there is a case I would chase Groupon, they sell the voucher so they can't just hide behind their T&C's.
