New phone bought of eBay faulty?

    Why not contact Apple again and explain that you can't afford to pay the security deposit and suggest that you send them the faulty phone and when they receive it, they can then send you the replacement.

    Or go in store if you can

    I suggested the OP do this but I think they said they didn't have a store nearby. Unfortunately I can't see the first page of this thread - that's an issue with my phone ironically!

    Right an update, declined, Decided in the sellers favor. I phoned and asked why it was declined, it was declined because Apple told me to do a factory reset from new which involves downloading the iOS software and reinstalling it to see it that solves the issue.

    The eBay guy also was a complete arrogant prant I might add:mad::mad: So bloody angry with him.

    I am not surprised it was declined, it isn't a SNAD. People really do need to understand what the Ebay Money Back Guarantee is, and it probably needs to have a name change as it isn't a guarantee either.

    This should help people appreciate that Ebay do read cases and they do decide in favour of the seller if the appropriate policy can be highlighted as being relevant.

    OP you really need to get to an Apple shop to get it sorted.

    I don't see how it's not SNAD. A new phone that on day 2 started to show problems, was that problem there from the start? Yes there's a good chance it was.

    Same thing if I bought a new car, on day 2 say the GPS stops working do I take it back to where I bought it or to the manufacturer? I take it back to where I bought it.

    Now if it did not have a manufacturer warranty what would of happened here?

    I could go the credit card charge back route but they tell me it's also risky as it goes through a 3rd party and the money could end up getting returned to Paypal.

    But Apple have offered to sort it out for you, just send it to them or go to one of their shops.

    This could have been sorted out some time ago.

    SNAD isn't a guarantee. Likewise as you had 'tried to effect a repair' by downloading new software, you are deemed to have 'accepted' the item.

    That is very different. Ebay are offering a dispute process above and beyond your legal entitlement. In your situation, the seller should have helped you but because he didn't you now have to apply the guarantee from the manufacturer, Apple. They have already said they will sort it out. I don't understand why you just don't get it done.
