New phone bought of eBay faulty?

Right an update, declined, Decided in the sellers favor. I phoned and asked why it was declined, it was declined because Apple told me to do a factory reset from new which involves downloading the iOS software and reinstalling it to see it that solves the issue.
The eBay guy also was a complete arrogant prant I might add:mad::mad: So bloody angry with him.0 -

I am not surprised it was declined, it isn't a SNAD. This should help people appreciate that Ebay do read cases and they do decide in favour of the seller if the appropriate policy can be highlighted as being relevant.

Same thing if I bought a new car, on day 2 say the GPS stops working do I take it back to where I bought it or to the manufacturer? I take it back to where I bought it.
Now if it did not have a manufacturer warranty what would of happened here?
I could go the credit card charge back route but they tell me it's also risky as it goes through a 3rd party and the money could end up getting returned to Paypal.0 -
But Apple have offered to sort it out for you, just send it to them or go to one of their shops.

SNAD isn't a guarantee. That is very different. Ebay are offering a dispute process above and beyond your legal entitlement. In your situation, the seller should have helped you but because he didn't you now have to apply the guarantee from the manufacturer, Apple. They have already said they will sort it out. I don't understand why you just don't get it done.0
