New phone bought of eBay faulty?

so I contacted Apple who said yes in warranty, they will send a replacement out and I send the faulty phone in now there is a security deposit which is the price of a new handset which is taken and refunded once I they receive the dodgy phone
Why not contact Apple again and explain that you can't afford to pay the security deposit and suggest that you send them the faulty phone and when they receive it, they can then send you the replacement.0 -
with my daughters phone - she had fault 11 1/2mths into warrenty, I rang apple (needed to get the itunes account unlocked as had 4got password) they sent me out a pre-paid box and labels, within 5 days I had recieved a new phone from them.xx rip dad... we had our ups and downs but we’re always be family xx0

Open the case for SNAD. The phone is clearly defective and almost certainly defective before it was sold. It was sold when it was not fit for purpose.
The seller can deal with Apple when they get their faulty phone back.
EDIT: I see you already did. Let us know how you get on. Hopefully the seller is held to account.0 -

I don't think an Apple warranty is transferable if the original owner sells on the phone within the warranty period?0 -

There is no month warranty. There is 30 days from latest estimated delivery to open a case. Ebay are quite clear there is no warranty, so it will depend on the wording and if the CS bother reading the case.

Whilst you are technically correct I suspect a buyer will win regardless as eBay do not differentiate between developed a fault and SNAD. I'm sure nearly every big seller in here can tell you their own story about losing a SNAD case several weeks after sale, I know I can. Indeed, my point being, we don't know what wording the buyer has used in opening the case.
You can defend a SNAD as a seller with the buyer saying 'it developed a fault'. All it takes is the seller to ring and escalate and speak with CS on the phone. So it will depend on what the buyer has actually said in the case.0 -

Yep and the seller is informs me this is what he will be doing on day 8. It may or may not affect this but this person sold the phone as new, Apple inform me its a "demo" unit what ever that means.0 -

Usually is fine, Apple just go by the serial number0
