    Probably a daft question but I'm thinking of ways to make life as difficult as possible for BW.

    Can I choose any court in the land to hold this case or does it have to be one close to where I live? I'd like it to be as far away as I can get from BW's base in Leeds thereby causing them are least some additional expense and inconvenience.

    They'll probably hire a local solictor anyway, who may not have even read their brief before they get there, so it doesn't really matter where it is. Or they'll just fail to turn up and you've wasted a lot of travelling time.

    I think you can request a court that's convenient for you, rather than nearest to your residence, so one near your work might be possible too. I'd stick with whichever one is closest to you anyway.

    I understand you'd need to have to provide a very good reason for requesting a court at some outlandishly located venue.

    Causing BWL inconvenience to give you the advantage, wouldn't be one that I'd be proffering.:cool:

    No don't do that as likely to backfire big time.

    Have you filed and served the DQ now on both parties.

    There is no reason why you should not ask for a hearing at your local local court.

    You also need to understand the mentality of BW Legal.

    This is well explained by the Prankster who states ..

    Thanks Beamerguy, an interesting read. I've decided against requesting the case to be heard at Truro county court ;) It's just rather annoying that my local court is not far from BW's base in Leeds so it'll be no bother for them to get there.
    Sending my DQ off tomorrow by 1st class post. I'll update as things progress. Going to start working on my FULL defence so any advice, examples, links that will help me with this would be very much appreciated. Thanks

    There will be examples here and (particularly) on PePiPoo- so some research is needed. Use search engines on both sites with 'BW Legal Defence' or 'Excel Defence' to find such examples.

    The following, which is neither a BWL, nor Excel, nor similar circumstances to yours is linked as an EXAMPLE ONLY of how a defence might be set out. Use only as an example - NOT for copying and pasting. In fact I'd be very careful about copying and pasting any defence, even one closely aligned to your event. Best work it up yourself, as you are going to have to speak to it if it gets to court.

    Just to clarify, I have already submitted my skeleton/bulletpoint defence so I am now working on my full defence which, from what I can gather, needs to expand on the points already made. What I'm not sure about is the level of additional detail I need to go into. My skeleton defence (on page 1) was probably more detailed than it needed to be so I'm hoping I don't need to add too much, but if I need to write War and Peace then I'd rather know sooner than later so I can get cracking :)


    I'll keep researching but so far I've found loads of skeleton defences but no full defences.
