HG destroys it!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Brilliant Lamilad - I'm (almost) jumping around my living room with joy!
This thread is a perfect example of how the collaboration between a scam victim willing to put the effort in and the sound advice of the amazing forum members (given for free) can beat these PPC scammers.
The law surrounding private parking is frustratingly complex but as clearly indicated by this thread also works in our favour as the PPC's and their merry hoards of legal (mis)advisers clearly struggle to adhere to it themselves.
Congratulations to Lamilad and all those who assisted him win this case - an absolute inspiration to all those scam victims about to go through this fight that they can and will win if they adhere to the expert advice given on here,
It's a shame you didn't get a double win yesterday and I wish you all the best for the adjourned hearing - I'll be watching closely!0 -

As each week goes by, we are all discovering the ignorance of parking companies and in particular dodgy so called solicitors who themselves are clueless.
Lami has shown everyone that you are dealing with the ultimate scammers and slowly, the judges are seeing this scam as a MEGA SCAM.
Excel and BWLegal and the other vermin are being dragged into the gutter where they belong.
Will Excel and BWLegal continue with this rubbish ? sadly yes because they at war with the motorist in an attempt to extort money
Lami has achieved more than the DCLG has achieved over the last year ... oh do remember that lady Theresa May .... ????
Look, Excel and the likes are just scamming companies, we all know that, they know that, a truly insignificant company but hey ... BWLEGAL an SRA approved solicitor not understanding the power of google ..... type in BWLegal into google and there are pages
that will put people off ever using them
In my mind, "the head cheese" of BWLegal should get medical advice and probably some sort of counselling0 -

MP Chris Evans states courts must learn from Scotland over ‘unfair’ county court judgments
Parking companies have been abusing the court process in droves

Hi,
Just an FYI, I know some users are being directed to my thread for research purposes and that's great... I really hope it's useful; but I've had to remove the photos which are linked on some of my posts (photobucket, Dropbox) as I'm concerned that excel and their henchmen are using them to identify me. I know my redacting has not been the best.
Anyway I'm probably locking the stable door after the horse has bolted but with one case still outstanding best to err on the side of caution.0 -

Understand what you are saying but there is nothing to worry about.
Your report was so comprehensive that it will help so many people under attack from these jokers.
Unless Excel start making false claims it is their horse that has bolted, BWLegal will be a here today, gone tomorrow company.
Clearly with all the complaints about BWL to the SRA and now BWL being ridiculed in court, they probably regret the day they ever got involved with Excel.
As there is no more that BWL can add to their claims, what they have done so far simply has not worked and they will be worried about the outcome of each case ... and so they should be.
Excel should be very concerned about how much each failed case will cost them .... probably a great deal of money
This is the penalty for greed. Even if Excel kicked out BWL, where would they go ? ..... Gladstones ? same will apply, Wright Hassall ? same will apply ... I doubt that any other solicitor would risk their reputation to support what is now a big scam in the UK.
"FOOLS WALK IN WHERE ANGELS FEAR TO TREAD"
Based on "damage limitation" alone, BWLegal should back away from this scammers industry before there are thousands of pages on google which will and is damaging them to a point that the public could never trust them0 -
Sensible words BG. It does seem like Excel/BWL are scraping the barrel when it comes to finding solicitors prepared to take on their cases.
No legal rep worth their salt would want to tarnish their reputation with these 'hospital passes' so they're left with the dregs... I gather they often rely on 'solicitors' looking for chambers; hence willing to sell their souls in the hope of going up against a hopelessly unprepared defendant who'll hand then an easy victory.
Makes me glad I've got a proper job0 -

Yes, and these are the fools. The county court system is small and I understand there is a "red card" that will indicate timewasters and firms who abuse the courts to which all judges have access to.
BWLegal are doing just that.
BWLegal should concede in a professional manner that they made a huge mistake, their knowledge was woefully lacking and that the Loake case was just a "pie in the sky" try on.
Even a law student could tell the difference between a criminal case and a civil case ..... tut tut0 -

But their overall strategy is debt collection, with the threat of litigation to back it up. One or two notable court scalps no doubt would have been stuck on pikes in subsequent threatograms to the unwary to ramp up the pressure.
So has this overall strategy 'simply not worked'? I think I'd be a little more circumspect in proclaiming that. I suspect it's working rather well and at the mkoment it's rather like a Las Vegas casino over at 91 Kirkstall Road. Please note, we are not a legal advice forum. In terms of court cases, possibly not. But we don't get involved in every such court case - in fact only two, Lamilad's fantastic win, and (if genuine) JJ's loss. Now that looks to me to be a rather thin sample on which to make such statements.

I have to agree with you in that we simply don't know how many people just pay up without a fight. The majority of people are savvy enough to ask questions via google and Excel/BWLegal seem to be going up the charts right now.
It is only a few months ago that BWLegal sent out their mega scam mail, so this is the time we will hear about the court cases as we are now.
BWLegal are running on a "one way claim ticket", they have shown their cards and the clever people on the forums will make sure it stays that way.
Due to their highly flawed claims the courts can block any claims just like they did with the PPI scam.
Personally, within my circle which is pretty big, nobody has heard of BWLegal so I do not think this has reached a Las Vegas style.
Whether or not BWLegal wish to be ridiculed in court is up to them and as we have now reached the time when this is happening, I am certain will hear more and more about their failures0
