I'm really not going to accept her telling me the claimant doesn't have to rely on pofa to prevail.

    Nor would I. That's preposterous.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, at least I have some idea of the judges predisposition. My focus will be,

    * E vs L, although it seems we might not even get to it.

This is not a case if the court gets to it ?

If in the claim, E vs L is part, then from the start you need to ask the judge what relation that case is to yours as it was a criminal case ... you (I) don't understand.
Even if the judge does not know of that case you have invited an answer and that must demand a reply.
The same applies to the Beavis case, the question is "what bearing does it have on this case ?

A judge must listen to you and I'm sure they would not wish to show their ignorance

I asked the OP for the claim number on their pepipoo thread. Not got it yet.

A Judge can't possibly have found that Schedule 4 wasn't breached. Excel don't even pretend to use that law.

Im skeptical of that case? Dont parking companies visit these forums. Maybe Excel set up a bogus profile and story.

Interesting! Could I ring the court and ask about this? Would they be allowed to give me any info?

It's especially interesting that this comment is on page 1 of JJ's thread from "Bengalnights"

"I would suggest pay it and forget about it especially if its at CC level"

It would really fit in with all the excel court papers being sent by bwlegal over the last month or so, including the one ill be defending.

Although in this case, im probably being paranoid. It was probably a very badly defended case.

If JJs case really went they way it did, BW Legal will start using it in their letters as a precedent rather than quoting irrelevant cases like Elliot v Loake.
  • Hi, never posted on here before but I'm researching excel as I'm up in court against them too. I just wondered if anyone has had a look at excels accounts? They're available online so I've been looking through them to see if there's anything I can use against them but I don't know what's what. Just thought I'd ask on here before I disregard them!

    Thanks 😊

Their financial accounts are very unlikely to have any bearing on your case.
