Thanks to all he will complain to the CMC regulator.
Sadly the regulator is useless.
Your complaint needs to go to Professional Personal Claims Ltd - details at foot of page http://www.lloydstsb-ppi.co.uk/terms-conditions
Then if you're not satisfied with the response you can go to the Legal Ombudsman.0 -
I have spoken to my son and he is adamant that the form from Professional Claims was returned in the same envelope as the copy of the original credit agreement. I have checked where the original request for this was sent and it is definitely Lloyds TSB Edinburgh. So how did it get to a Claims Company?0

I will be honest here and say that Lloyds would not be associated with any CMC so the form he claims went to them in the post did not happen, I believe that he has made a mistake and therefore looking for a way out here and the most likely explanation is that he did sign up with them earlier and it crossed with the Lloyds forms, Once he signed up with them that would have made him eligible for the charging of a fee.
No bank in the UK would work alongside any CMC here as there would uproar, You may wish to believe your son and have every right to but seriously he is telling porkies about this situation.0 -
Thanks for your honesty. I will have a word with him again but it would be highly unlikely that he would complete a form and send it off without my knowledge.0

It took me 2 years to get him to start the claim lol. I don't think he would sign anything without my knowledge, but he can still surprise me at 350

Regardless of what your son says (or thinks) happened, the Claim Firm will have sent their own application forms and "claim pack". The bank will have had no involvement.
The fact that it was placed in the same envelope suggests it was perhaps put there just to keep everything together and you are just assuming it came from the Bank in that envelope.
If you complain to the Bank, they'll simply refute your version of events.
However, if you want to complain and be successful you need to forget all about Lloyds Bank and concentrate instead on making a compelling and above all accurate complaint direct to Personal Claims.
Your complaint should focus on how your son (a vulnerable adult) was taken in by the appearance of the website and thought that he was dealing with a company officially authorised by Lloyds Bank.
The Claims firm will have eight weeks to consider your concerns, but if they reject your complaint or if you remain unhappy with whatever they offer as a resolution you can then refer to the Legal Ombudsman.0 -
My son is going to ring the bank and go through the claim with them. He understands that they will confirm that the claim came from Prof Personal Claims. We have drafted a letter to the Claims company asking for a full copy of the claim form and how his request came to be in their possession. I have questioned him in depth and he assures me that the claim form and copy of the Credit Agreement were in the same envelope. The request for this was definitely sent to Lloyds Bank in Edinburgh. My son did not look at any claim firm on the internet.0

I have no idea how your son came to be the customer of Personal Claims Ltd, but I can state categorically that Lloyds, in common with other banks, does not align itself with any Claim Company.
If you make any complaint to the Bank on that basis, it will be rejected without ceremony.
Your only chance of not paying the £688 is to do as suggested and complain directly to Personal Claims Ltd. Do note that unsubstantiated accusations of wrong-doing by Lloyds Bank will weaken your complaint, not strengthen it.0
