I will get him to ring and check things

A long way from Glasgow! Southend on Sea is where your son sent complaint. The CMC would forward it to the free of charge complaints address of Lloyds in Glasgow.

    No connection to Lloyds Bank.

It sounds like you are mistaken that the Claim Company contract was included with the letter refusing your son's futile attempt to get the original credit agreement.

There really is no point in contacting the Bank over this. You say yourself that

As he doesn't live with me I didn't get a chance to see the form properly
So you only have your son's word that it was in the envelope from the Bank. It really, really couldn't have been.

The letter he sent to the Bank is not the problem. He must have had contact with the Claims Company additionally. This could have been via telephone, a website or separately via the post.

You freely admit you don't live with your son and didn't see the form that was returned to the company. The form will not have been sent to the Bank's address, it will have gone to the claim company's address. The Claim Company will then have forwarded the complaint to the Bank (acting on your son's signed permission to do so) and it will indeed have been Lloyds Bank who telephoned you to ask questions about your complaint.

It sounds very much like you are confusing your son's actions and so accusing the Bank. Lloyds will have paid ALL the redress to your son, but payment to the Claims firm is your son's responsibility and I don't see how the Bank can be held in any way liable.

The title of this thread is totally mis-leading. It should read "Beware signing up to a Claims Management Company".

Your son has signed the CMC contract and if it's a legally binding document, I can't see any way the fee might be waived.

My son did get the copy of the credit agreement and the form from the CMC was enclosed with it. But as you say my son may have been mistaken. He has ADD and I foolishly did not take a photocopy of the form when we posted it.
I have spoken to Lloyds Bank PPI complaints and they have asked me to get him to ring them himself and then they can look through the details and let him know.

    That figures.

    They're a Lloyds lookalike outfit - http://www.lloydstsb-ppi.co.uk/

Given your son has AAD and the website is a copycat job I would file a formal complaint on the basis that your son may have been misled and that they may have breached Principle 2 (f) of the Conduct of Authorised Persons Rules (early identification and protection of vulnerable consumers) https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/380623/CMR_Conduct_of_Authorised_Persons_Rules_Oct14a.pdf

    Groan.

How do you know it's 'legally binding'? Have you seen it? Do you know the circumstances in which it was formed?

As already stated, there is no point in contacting the Bank at all. Do as user "Alpine Star" suggests in the above post and complain to the CMC direct, but do be sure of the facts before doing so.
Lloyds really really didn't send your son a claim company referral..

I agree there is likely to be a legitimate complaint here, especially if the OP's son is classed as a vulnerable adult, but you don't appear to be any more in full possession of the facts than I am.

The OP will obviously need to be absolutely clear over what happened and how.

Alpine Star, you need to edit your link and re-size it so that it is readable on the forum.
