Amazon - Purchased item that was incorrectly advertised with cashback

Hi,

Just wanted to hear what people think please.

Bought a Canon lens from Amazon that is advertised on the website as being part of Canon's cashback deal.

Bought it on 1st June, delivered on 6th June and then tried to register for the cashback on Canon's website but the model is not on their list as being in the offer. I sent Amazon an email (via Contact us) on the 6th June but haven't heard anything back so I rang them this morning (11th June), and they, in short, told me that they wouldn't be able to honour the cashback themselves and to send it back for a refund. They said they would investigate the offer on their (Amazons) website.

I bought it because the cashback made it more appealing and affordable. Where do I stand on this? Would it be worth raising it with trading standards? Ultimately, I'd like to get the cashback.

    Sounds like a genuine error, especially as Amazon have offered you the opportunity to send it back for a refund.

    Bottom line is, you'll end up with either of two options.

    1) Send it back for a full refund
    2) Keep it and not have the cashback

    By all means you can complain to TS via CAB, however this won't get you anywhere.

    Then make sure they know and check in a few days that they've corrected the error. Your options remain the same.

    This can happen on Amazon where marketplace sellers also have access to the description, they make changes for similar items and it affects the listing for all sellers. Or it could be a listing error on the part of Amazon.

    These things happen, we all make mistakes at times.

    That lens is listed on the canon cashback site http://www.canon.co.uk/cashback/current-cashback/#eligibleproducts (for some raeson saying £75 cashback) depite at the top saying you can get upto £50 on selected products

    No, it is the Image Stabilisation version of that lens - with the letters 'IS' in the product name i.e. EF 70-200mm f/4L IS USM - that qualifies for a cashback.

    In theory, since the sales contract was agreed, you could sue for "loss of bargain". Essentially, Amazon have a contract with you to supply the goods at the agreed price. The goods would include the offer of cashback.

    If Amazon are now refusing to honour the terms of the sales contract and are cancelling the sale, you could sue for "loss of bargain". Essentially, you buy the cheapest available identical product, and sue Amazon for the difference between what you had to spend and the agreed cost of the goods from Amazon.

    You'd need to confirm that the cashback offer details implied or inferred that the item you were buying was eligible for the deal, of course.

    Send a "notice before action" by recorded delivery advising of your intentions to sue.

    And... as I'm not a lawyer, do your own research first! :-)
