    Let me try and explain this in an other way, for you think like a typical civil servant: The freedom to contract is a natural right ie it runs in the blood( it has not been granted by parliament) you can only disturb this right by a fully “VESTED” act of parliament it can be disturbed in no other way for it is said to be sacrosanct. Hence the incorporating of the HRA by “act of parliament” other natural rights. That is my opinion, so let the matter between us rest there and let the courts decide. That is what I mean when i say the case can't be used to set a precedent.
