Worst, worst case and you can't fix this, is you still don't need a new laptop, just get a new hard drive for £25 and reinstall your chosen OS from scratch0

Don't even necessarily need a new HDD. If there's a spare pendrive big enough to back up necessary data, just run a Linux LiveCD to save the data to pendrive, then reinstall Linux in the laptop using the same LiveCD (making sure to wipe/format the HDD as part of the process).0

Are you sure they haven't just logged into the router?
Have you changed the SSID, and, for safety sake, the user name and password to access the router controls?0
