Furthermore I do not have to prove anything. If the cyclist wants to claid against my insurance the burden of proof is on him. The standard of proof is on the balance of probabilities. This means the cyclist must prove beyond 50% certainly that I was wrong and he cannot do this because there is no evidence against me.
You over took someone turning right. He was ahead of you, now prove you did nothing wrong. You can so your insurance will pay out. The cyclist will not have to prove anything as your insurance company won't take this to court. They'll pay and in turn you'll pay with an st fault claim and increased premiums.0 -
Kraken776, you just don't get it, do you? None of us were there. Neither were the insurance companies and in the absence of footage or an independent witness, it would seem from your description of events that you will be held liable. I have no idea if you are really to blame, and nor do I care.

Why would I need to make up excuses? I have no interest in which way this goes. All I and others have done is to answer your question. You don't like the answers you're getting? Tough. Deal with it. Taking it out on other forum users isn't going to swing the case in your favour, or reduce your premiums when, as seems likely, your insurance company pays out.0 -

Case solved then. What are you worrying about? You're blameless, the cyclist will be deemed culpable and your insurance will be unaffected.

if someone else wants to make a claim against my insurer THEY need evidence not me.
as for proof in this case
My car and the bike finished on the other side of the road.
The damage is on the front CORNER of my car and the front SIDE of the bike
The only way this could happen is if he turned into my path
If the damage had been clearly on the side of the bike (no frontal involvement) it would show that the bike turned into my path as well.
The only way the evidence would be against me is if the damage on the bike was on the back of it with no side involvement0 -
