DLA to PIP Question

I am trying to find out what the procedure is if your PIP claim is refused when you move from DLA.

I know they continue to pay DLA until DWP make a decision on PIP.

I thought I had read somewhere that if DWP decide not to award PIP, they will pay your DLA for one month after the decision date.

Can anyone confirm this for me as I can't find it now and am trying to plan ahead with my finances in case I get turned down, my assessment is this Thursday:eek:

    I got a decision and on the letter it said they would pay me 28 days DLA from the date of the decision. The payment was on a different day from normal and out of my normal payment schedule.

    My mums carers allowance stopped on the same day too.

    Thank you for that I can at least plan ahead a little now and budget for what I expect to happen, if it works out different then it will be a bonus. Given what has happened to a lot of people though I don't expect any good news........

    I am quite surprised by how quick things have moved from returning the form, it was under 3 weeks for the appointment for the assessment to drop on the door mat and only 10 days notice to the appointment with fear itself. The day before it came I fell and broke my wrist and cracked 2 ribs, so I rang and explained and asked if they could give me another appointment as it is a 25 mile journey and I was battered and bruised. They gave me an extra 6 days grace and that was the maximum they would give me......... So caring they are!!!

    I don't suppose it will be too long from the assessment to the dreaded letter landing either.

    I think it should be phased out over a few months if they disallow PIP when you have a lifetime DLA decision, as it has massive implications on peoples lives. At least I won't lose my car though as I bought my own rather than a mobility one. I really feel for all those that have that ripped away as well!

    Have you gone down the appeal route?

    Yeah I appealed and won. Process took from Mid-December until last week.

    The DWP have their usual 28 days to appeal the tribunal decision but I don't see them bothering

    Congratulations Jen - I was concerned
    Did you get any apology ?
    I was in a similar position, 10 years ago when my DLA was reduced from MAX care + MAX mobility to ZERO in one fell swoop - I appealed (through my MP) - won and heard back within a fortnight that I had won and was given a LIFETIME AWARD of Mid care - this apparently means diddly squat though - "they change the name = they change the rules" !!

    No apology but the HCP is being disciplined by his professional body and I have 3 separate complaints sitting on Andrew Rhodes desk.

    So pleased to hear that you've finally got justice Jen but am disgusted by their appalling treatment of you. Can your mum reclaim carers now or does she have to wait for DWP to confirm they're not appealing (which I'm sure they won't). xx
