If the cost goes over our initial contract I'll have to pursue small courts as he won't give us any money back.
He not a limited company, so far just found out he is training under a different name to what is on our contract.
Following legal advice and have given him a number of days to complete works stated in our agreement.0 -
The fact that Howdens are not discussing it with you does not mean that they are not taking it seriously. Their employee has been misrepresenting himself to you and running his own business on their time. Plus the pair of them have taken money from you and you are about to go to the small claims court over it. I should think they take that very seriously. I hope you have kept all the emails.0

I find it amazing there are now 80 replies and yet the lateral thinking approach has probably not been adopted. Bluntly why not name and shame the branch of Howdens? This will not be detrimental to any legal recourse and could achieve a satisfactory result without going to the courts.
Think through the scenario. Say the branch is at Reading. Do you think all the kitchen fitters and carpenters in Reading will want any dealings with "Hi, I am Tom Smith from Howden's Reading branch, who is also the subject of 80 posts on mse Forum?
Why so? Because they will know he is going underhand to poach work that should be theirs, and in the process tarnishing the whole industry in the locality.
Then the next level. "Hi I am Alex Nobody, the Branch Manager at Reading. I am instigating disciplinary procedures against Tom Smith. Why? Because my sales figures are falling, and my bonus is suffering. Yes I have long known what Tom has been up to, but now it is hitting me in the pocket. I cannot keep turning a blind eye, so enough is enough.0 -
