They've seen us putting the contract in our livingroom as the kitchen is directly off the living room space and they were carrying out work at the time, also all the building materials and tools were stored in the living room. I have a copy of the contract via email they've taken the one I signed.0

I think you need to take the heat out of this. Don't ring him five times a day
Send him an email: basic - "as we didn't hear from you on the weekend, when are you coming to finish the kitchen?"
If you don't hear from him Monday, give him a call (leave a message if you don't get through).
Then you can give him an 'official' 14 days to sort things out (email & write).
Then it is 'letter before action' time.
It does sound like there is slightly more to this than we know from this thread.0 -

Update: have just received a call from the builder saying stop calling my brother and the work thats been done so far equates to what I paid. I said that he agreed to complete the job and all the jobs stated in the contract are incomplete. He then states he thought I was rude which is not accurate at all and started to create situations which did not happen. Anyway the outcome was he stated in a round about way the contract signed is not worth nothing and he will not be completing the job, if i apologise and take liability for the situation he'll maybe think about it and stop calling his brother and head office of howdens and put the phone down.
Clearly he is dishonest, creating situations which did not happen/occur, was quite argumentative, I only ever spoke to him when he was doing something that was not in the works of our contract such as disposing of building waste on my property and he continued to refuse to listen to a word I had to say.
Maybe a simple apology could move this forward?0 -

Yes attempted to apologise for any misunderstanding but he wouldn't listen. I have backed off, will try one more time Monday, their is not more to this I have been updating with updates and this is the situation so far.

He is wrong about an unsigned contract. The fact he has started instigates a contract. You have a contract in hand, signed or not. And proof of bank transfers to his account. And an unfinished kitchen. Together that is overwhelming evidence of a contract.

I definitely think you should make it clear to Howdens that the two of them were in it together, not just wearing Howdens shirts but one dealing with you from Howdens email so presumably at work.
Clearly Howdens have been asking questions and the one who works for them has got cold feet hence the phone call by the other one warning you off. Howdens will not be liable to reimburse you if it is shown to be a scam nothing to do with them directly but they will want to check out their employee's role. It may be that their employees are not allowed to trade with the public except in an official capacity. Are you sure he is a designer for them? i think unlikely they would want him operating scams using their name and computer resources in his work time to bring them into disrepute.
I think you need to write to their Chief Executive explaining what has happened and asking them to investigate. This may frighten the pair into reimbursing you some money and at very least stop them doing it to someone else. You should
also report them to the trades site where you found them in the first place again to stop them doing it to someone else.0 -
Howdens will be vicariously liable for all of their employees actions whilst working for or representing the company. They may also be liable at other times, depending on the circumstances.0
