N1 claim form - Hoist portfolio

Hi - I am new to this site and looking for a little advice, I have today received a N1 claim form from Nothampton county court business centre. This debt relates to an old Barclaycard I took out in 2003 - I had huge financial difficulty in around 2008/2009 which resulted in me not being able to make payments ( accident at home so couldn't work for 6 months) anyway all fixed now and back in work, I suspect that the last payment I made on this account was more than 6 years ago ? How can I find this out ? I am very keen not to have a CCJ listed against me for this as have worked extremely hard to improve credit rating. Any advice would be appreciated ? I am not in a position to pay £ 4,000 but could probably pull together £2,000 at a real push. Your advice would be great ? Thanks

Even if you had made a payment in 2009, it would still be 7 years ago, meaning the debt is statute barred.

Thank for prompt response - I do owe this cash so it's only fair I pay it back, I am desperate not to have a CCJ issued against me , is it too late now to stop a CCJ ?0

Hi - I have now Checked on experian and the last payment I made to Barclaycard was August 2011 - assuming experian is correct doe this mean that my debt which was passed over to Hoist is not statute barred ?
So if this is the case how can I stop a CCJ being issued against me ? Is the only way to pay the amount on the N1 claim form ? Is it worth trying to negotiate a lower payment in full amount - as I can only pull together £2k ?

So it sounds as though there is still over a year to go until it is statute barred.
Who did you owe the money too and who is claiming the money now, it may well have been sold on for a fraction of the amount you owed, so if you contact them they may well be open to an offer as they wont have been owed all the money you originally defaulted on.
Edit - as noted on other threads once agreed you need to confirm this in writing stating this is a full and final settlement to ensure they don't come back and try for some more.0 -
I owed the cash to Barclaycard £3,033 , Hoist purchased the debt in February 2012 and haven't chased, until a couple of weeks ago when the wrote to me to confirm it had been brought to their attention that my credit rating had improved. Hence now have a N1 form for £4,333 I assume the increase is charges and interest , plus the N1 form confirms that I am being charged 0.67p per day interest - robinson way were dealing on behalf of Hoist portfolio - obviously time is ticking by on the N1 return - will it be in order for me to email robinson way. And offer £2,500 now in full and final settlement or is it too late ? That's all I can get hold of within the next 7 days - all advice eappreicted0
