Did you actually contact TW before may this year about this specific problem?

We have complained about the smell before to them (within the first 2 years).

However when they would check it had gone as they would check during the day when most people are out and so there was very little movement in the waste pipes from our neighbours, so no or very little smell.

We were told it will settle down and we were told this on numerous occasions.

This is positive news, but did you submit your concern in writing, was this to the Head/Regional Office (basically the address used for conveyancing/NHBC), and have you kept records of this that can be produced as evidence?

Did you similarly record the unsatisfactory visits from TW employees/contractors?

Get local MP/newspaper involved can help focus minds at these shyster companies.

This could be excellent advice, or it could be counter productive.

Nobody knows how TW would view this. One scenario is a satisfactory settlement, but the problem is the press/media tend never to follow up on stories. So if TW placate the press/media they might subsequently back off again when the spot light is no longer on them.

Equally the compensation is a goodwill/ex-gratia gesture, with no admission of liability. (Or words along these lines would be typical). Getting press/media involved could provoke TW to say bo--ocks to OP, and withdraw the offer of compensation.

Never an easy route to go down, nor an easy decision to make.

Which is exactly why I wanted to give TW a fair shot first before thinking of posting here or considering speaking to media etc.

I have gotten so far as to begin discussing with their loss adjusters (or at least have been notified they will be in touch). As this appears to be as far as I can go by myself I put the post up to see if, other than stating the facts, there is anything else that can help my case.

I do not know why a loss adjuster is getting involved, but this does not sound good for you. The LA will want to justify their role, and fees, and will be determined to minimise anything paid to you.

I am surprised TW are not dealing with this in house, and wonder if you may have done something to bring this about. Alternatively you may have done nothing about matters in the eyes of TW so they have suggested the LA.

A likely accounting scenario is the LA fees will come out of the money that might have been awarded you as compensation. Do not be surprised if you get a nominal sum, if anything at all.
  • I dont think a using a loss adjuster is going to do you any favours here in terms of the sum you expect to receive, as previously mentioned it wont leave you with a lot after fees etc are taken.

Can you prove any loss or expense to yourself as a result of this situation?
