Driveway right of way EDITED PLAN AND INFO

if only the dumb developer had not built the garages in that spot and instead on 90's land.....When using the housing forum please use the sticky threads for valuable information.0

Having looked at the plan again I realise that 89 is going to have a parking problem because of the way the development is built there is never going to be enough room to turn the car round. If you drive down the shared drive forwards and park in the drive facing up the drive because of the position of the non shared land of the parking spaces and the position of the garden of the house the other side you would probably have to reverse out up the shared drive. I would imagine that putting planters onto the drive would just make everything twice as difficult?0

True - and some of us know from personal experience about "dumb developers" creating problems where none need exist.0

I'm wondering how long the road is as a whole - ie how much space there is for everyone to reverse back down to that "quirk" if that's what happens.
The road is probably adequate for 3 vehicles to park nose to nose on one side - 4 at a push but only if people were able to move all of them at once iyswim, to shuffle them.
The driveway joins the main road at a dog leg just inside the estate. Vehicles are coming off the 40mph main road into the estate and this is the first bit that slows them down. This I think is why people prefer to make maneuvers on the driveway rather than reversing up it or down it. xxx0 -

The developer has built the garages on 90s land. The plot for 90 is not square it includes the garages and the parking spaces in front of the garages. The parking spaces in front of the garages are effectively the drive for no 90. No 90 has the right to access their "drive" and to park two vehicles on it.0 -

89 has a right to use the area in front of 90's garages as a turning circle.0 -

The fence would have to be entirely on 89s land it couldn't be on the boundary because it could not be at all on the parking spaces for no 90 because that land does not belong to 89 and is not shared.0 -
Why doesn't 90 park in their garage?0

Is this true? Or is the dotted line an indication of the shared driveway. Wouldn't it be a solid line if true? So it may be that number 90 owns it but 89 and others have the right to access it.
The most logical way to drive is forward towards the garages and then reverse into individual driveways. Therefore leaving the property you are facing the right way.
Either way those flower pots are on shared driveway and shouldn't be there. Should number 89 wish to put a fence on their boundary, they can do so. Unless there is another clause preventing front fencing for appearance's sake. (Even then a ow of holly bushes would be allowed and have the desired effect.)I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Why doesn't 90 park in their garage?
I'm guessing that garage size is not sufficient for big cars.
Really that whole shared driveway should be kept clear. What happens if there is a fire at number 90, fire engine needs access, not to weave between flower pots and parked cars.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
